About entering of amendments and changes into some resolutions of Council of Ministers of the Republic of Belarus concerning the address with consumer wastes

For the purpose of implementation of the Presidential decree of the Republic of Belarus of July 28, 2014 "About entering of amendments and changes into presidential decrees of the Republic of Belarus concerning enhancement of system of the address with consumer wastes" the Council of Ministers of the Republic of Belarus DECIDES: No. 381

1. Item 5 of the Regulations on the Ministry of Taxes and Tax Collection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1592 "Questions of the Ministry of Taxes and Tax Collection of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2001, No. 106, 5/9345; 2010, No. 71, 5/31466) to add with subitem 5.1.8-1 of the following content:

"5.1.8-1. correctness of calculation, timeliness and completeness of introduction of payment for the organization of collection, neutralization and (or) use of waste of goods and waste of packaging;".

2. Bring in the resolution of Council of Ministers of the Republic of Belarus of July 31, 2012 No. 708 "About measures for implementation of the Presidential decree of the Republic of Belarus of July 11, 2012 No. 313" (The national legal Internet portal of the Republic of Belarus, 08.08. 2012, 5/36073; 22:02. 2014, 5/38460) following amendments and changes:

2.1. in Item 1:

2.1.1. in paragraph three:

after the word "(settlement)" to add the paragraph with the word "bank";

"1-2. Determine that:

the payment amount which is subject to introduction on the current (settlement) bank account of the operator is estimated in producers and suppliers proceeding from quantity of the goods made and realized in the territory of the Republic of Belarus and (or) imported called in appendix to the Presidential decree of the Republic of Belarus of July 11, 2012 No. 313, of polymeric, glass, paper and (or) cardboard packagings, packaging from the combined materials into which the imported goods, and the amount of the payment brought by producers and suppliers on the current (settlement) bank account of the operator for the organization of the collection, neutralization and (or) use of waste of goods and waste of packaging approved by this resolution and operating for date of emergence of obligation on ensuring collection are packed neutralizations and (or) uses of waste of goods and waste of packaging according to part four of subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of July 11, 2012 No. 313;

in case of commodity importation, packed into several types of packaging (from one or different materials) at the same time, the obligation of the supplier on ensuring collection, neutralization and (or) use of the waste which are formed after loss of consumer properties of packaging arises on each type of packaging;

in case of commodity importation, called in appendix to the Presidential decree of the Republic of Belarus of July 11, 2012 No. 313 and the combined materials packed into polymeric, glass, paper and (or) cardboard packagings, packaging from, the obligation of the supplier on ensuring collection, neutralization and (or) use of waste of goods and waste of packaging extends to goods and packaging into which it is packed;

when calculating the amount of the payment established percentage of the cost of goods, the supplier uses the cost of the imported goods according to the agreement in foreign trade excluding tax on value added, customs payments and transportation expenses, and the producer - complete cost * the made and realized goods. If the cost of the imported goods in the agreement in foreign trade is specified in foreign currency, calculation of payment is made at the rate of National Bank for date of emergence of obligation on ensuring collection, neutralization and (or) use of waste of goods and waste of packaging according to part four of subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of July 11, 2012 with No. 313;

if producers and suppliers in the accounting period apply own system of collection of waste, but collection, neutralization and (or) use of waste of goods and waste of packaging in the quantity determined according to paragraphs the third and fourth subitem 1.4 of Item 1 of the Presidential decree of the Republic of Belarus of July 11, 2012 No. 313, these producers and suppliers is not provided shall sign the contract with the operator and bring on its current (settlement) bank account payment proceeding from quantity of the goods made and realized in the territory of the Republic of Belarus and (or) imported called in appendix to the Presidential decree of the Republic of Belarus of the July 11, 2012 No. 313, and polymeric, glass, paper and (or) cardboard packagings, packaging from the combined materials into which the imported goods are packed calculated as follows:
