About modification and amendments in the Law of the Republic of Tajikistan "About pledge of personal estate"

Article 1. Bring in the Law of the Republic of Tajikistan of March 1, 2005 "About pledge of personal estate" (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2005, No. 3, Art. 133; The Law of the Republic of Tajikistan of July 26, 2014, No. 1117) the following changes and amendments:

1. To write the name of the Law with capital letters.

2. To state part 7 of Article 7 in the following edition:

"7. The description of subject of pledge can be individual or general in the degree allowing to determine pledge subject at the time of emergence of question concerning reality, priority or forced implementation of pledge.".

3. In Article 32:

- state part 1 in the following edition:

"1. Pawnshop is the legal entity (the specialized organization) occupied with provision of short-term loans instead of being on the security of personal estate of citizens, and also storage of personal estate of citizens.";

- to add part 2 after the word "Tajikistan" with words "and the Law of the Republic of Tajikistan "About pawnshop";

- exclude parts 4 and 5.

4. Add Chapter 9 with Article 59 (1) the following content:

"Article 59 (1). Responsibility for non-compliance with requirements of this Law

Physical persons and legal entities bear responsibility for non-compliance with requirements of this Law according to the procedure, established by the legislation of the Republic of Tajikistan.".
