About modification and amendments in the Code of penal procedure of the Kyrgyz Republic

Bring in the Code of penal procedure of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1999, No. 10, the Art. 442) the following changes and amendment:
1. To state Item 1 of part 1 of Article 42 in the following edition:
"1) to receive copies of resolutions on attraction it as the person accused, purpose of examinations, the indictment and the copy of the protocol of the accelerated pre-judicial production;".
2. To state parts 2 and 3 of Article 156 in the following edition:
"(2) the Decision on initiation of legal proceedings or on refusal in its excitement shall be accepted in three-day time, and on the materials requiring additional check - in time no more than ten days.
In case of impossibility of decision making in the specified terms this term can be extended by the prosecutor up to one month under the motivated resolution of the investigator in the presence of one of the following circumstances:
1) purposes of examination, office investigation, the documenting audit or other check requiring long time for their carrying out;
2) need of reclamation of explanation at the persons which are in the remote areas or evading from appearance on challenges;
3) establishments of new circumstances without which additional check decision making is impossible.
About prolongation of term of consideration of the application by the investigator it is reported to the applicant in writing.
(3) About initiation of legal proceedings or about refusal in its excitement it is reported to person, the organization or the official from whom the statement or the message on crime arrived. At their request the copy of the relevant resolution is submitted.".
