About modification and amendments in the Law on electronic communications No. 241-XVI of November 15, 2007

The Parliament adopts this organic law.

Art. I. - In the Law on electronic communications No. 241-XVI of November 15, 2007 (Official monitor of the Republic of Moldova, 2008, Art. No. 51-54, 155), with subsequent changes, to make the following changes and additions:

1. In Article 2:

after the concept "radio communication" to add Article with concept of the following content:

"resources of radio-frequency range - strip or substrip of radio frequencies, radio frequencies and/or radio channels, held for use in radio communication;";

after the concept "station of radio communication" to add Article with concept of the following content:

"substrip of radio frequencies - part of strip of radio frequencies with certain width of transmission;";

after the concept "digital land television" to add Article with concept of the following content:

"hoarding of resources of radio-frequency range - action for accumulating and non-use of the limited resources of radio-frequency range which are public property of the state, the owner of the license to use of these resources, creating barriers to occurrence on the market and leading to restriction, preventing or misstatement of the competition;".

2. In part (1) Article 7 of the word "Ministry of Information Development" shall be replaced with words "The ministry of information technologies and bonds".

3. Part (Article 9 to state 2) in the following edition:

"(2) For the purpose of realization of provisions of this law Agency cooperates with the central industry body, Competition council, control facility in the field of processing of personal data and with other bodies of the public power, including by mutual exchange of information, necessary for application of provisions of the legislation on electronic communications, legislations in the field of the competition and the legislation on personal data protection. The cooperation of the Agency with the specified bodies is performed according to differentiation of the functions and powers determined by the law.".
