About modification and amendments in some legal acts of the Kyrgyz Republic

Article 1. Bring in part I of the Civil code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1996, No. 6, the Art. 80) the following change:
to state item 4 of Article 335 in the following edition:
"4. Collection regarding pledge can be turned only by a court decision if the pledged property is carried in the procedure established by the legislation to the property having considerable historical, art or other cultural value for society and also if subject of pledge is the single housing belonging on the property right to physical person.
This regulation does not extend to the apartment house or the apartment acquired or built with use of loan money (credit) of bank or other credit institution or means of the target loan granted by other physical person or legal entity encumbered with mortgage.".
Article 2. Bring in the Law of the Kyrgyz Republic "About pledge" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2005, No. 6, the Art. 377) the following amendments and changes:
1. To add item 4 of Article 31 after words of "agreed payment terms" with the words "according to Item 2 of article 56 of this Law".
2. To state Item 1 of Article 62 in the following edition:
"1. The address of collection regarding pledge can be made judicially based on the judgment if the possibility of the address of collection regarding pledge extrajudicially is not provided in the pledge agreement.
Collection regarding pledge can be turned only by a court decision if the pledged property is carried in the procedure established by the legislation to the property having considerable historical, art or other cultural value for society and also if subject of pledge are the single premises belonging on the property right to physical person, except as specified, of the stipulated in Article 42-1 this Law.".
3. Third Article 65 to state the paragraph in the following edition:
