On tariff regulation in the field of housing and communal services

For the purpose of enhancement of procedure for regulation of rates (prices) of housing-and-municipal and other services in the field of housing and communal services, and also the state support of the population:

1. Determine that:

1.1. the rates (prices) of housing and communal services subsidized by the state for the population * and rate for service in management of common property of joint household in apartment houses are established according to the legislation on pricing prior to the beginning of the next financial year taking into account growth of the income of the population, and also cost recovery parameters on rendering such services at the expense of all sources determined annually by the law on the republican budget for the next financial year;

* For the purposes of this Decree the rates (prices) of housing and communal services subsidized by the state for the population are understood as rates (prices) of services in maintenance, capital repairs of the apartment house, to water supply, water disposal (sewerage), gas supply, supply with the liquefied hydrocarbon gas from individual balloon or reservoir installations, to electric utility service and heat supply, maintenance of the elevator, the address with solid utility waste when which rendering part of costs is compensated at the expense of budgetary funds and (or) other sources.

1.2. increase in the rates (prices) of housing and communal services subsidized by the state for the population and rate for service in management of common property of joint household in apartment houses is performed annually since January 1 and since June 1 proceeding from the admissible growth of payments of the population for such services in the total annual size which is not exceeding 0,5 of basic size according to parameters of the forecast of social and economic development of the Republic of Belarus for the next financial year counting on the family of three people living in two-room apartment with a total area of 48 sq.m in case of normative consumption of housing and communal services. The procedure of payments of the specified payments and level of compensation by the population of costs for rendering housing and communal services is determined by the Ministry of anti-monopoly regulation and trade, the Ministry of Housing and Public Utilities, the Department of Energy and the Ministry of Finance;

1.3. increase in the rates (prices) of housing and communal services subsidized by the state for the population and rate for service in management of common property of joint household in apartment houses is higher than growth of payments, this Item established in subitem 1.2, is performed in coordination with the President of the Republic of Belarus;

1.4. the rates (prices) of housing and communal services subsidized by the state for the population and rate for service in management of common property of joint household in apartment houses are quarterly indexed within financial year taking into account growth of the income of the population in the sizes which are not exceeding actually developed growth rates of nominal accrued payroll across the Republic of Belarus for the last quarter including on services:

gas supply, supply with the liquefied hydrocarbon gas from individual balloon or reservoir installations, electric utility service, heat supply - Council of Ministers of the Republic of Belarus;

water supply, water disposal (sewerage), according to the address with solid utility waste, to maintenance and capital repairs of the apartment house, maintenance of the elevator, management of common property of joint household in apartment houses - regional executive committees and the Minsk Gorispolkom in coordination with the Ministry of anti-monopoly regulation and trade.

The procedure of payments and introduction of payment for housing and communal services, service in management of common property of joint household in apartment houses and payments for use of premises of the state housing stock, procedure for indexation of the rates (prices) of housing and communal services subsidized by the state for the population are established by Council of Ministers of the Republic of Belarus taking into account requirements of this Decree and other legal acts;

1.5. the full recovery of costs for the housing and communal services provided to the population at the expense of all sources provided by the law on the republican budget for the next financial year is obligatory;

1.6. costs for the housing and communal services provided to the population which are not provided with financing sources in connection with not achievement of parameters on the level of their compensation for the account of the rates (prices) of such services subsidized by the state for the population or rates (prices) of utilities for the legal entities provided by the law on the republican budget for the next financial year are subject to compensation for the account of subsidies from the local budgets calculated proceeding from amounts of the housing and communal services rendered to the population and norms of subsidizing of unit of housing-and-municipal service determined according to the legislation;

1.7. sources of financing of the current and capital repairs of housing stock are means of local budgets and means from introduction by owners, employers of premises and members of the organizations of builders of payment for the running, capital repairs, and also other sources of financing which are not prohibited by the legislation.
