About modification of the Law of the Republic of Armenia "About the introduction of the Judicial code in force"

Article 1. "About the introduction of the Judicial code in force" to state article 2.1 of the Law of the Republic of Armenia in the following edition:
"Article 2.1. To the Republic of Armenia appointed by the Law "About national pensions" old-age pensions (further – national pension) the person who worked in judgeship of 10 and more years and dismissed on the bases provided by part Items 1 and 5 1, and also Item 2 of part 4 of article 167 of the Judicial Code of the Republic of Armenia monthly surcharge (further – surcharge) in the amount of difference between 55 percent of the average salary received on post as the judge within the last 1st year and national pension is established.
The procedure for calculation of the average salary, calculation, appointment and payment of surcharge, and also calculation of years of service is established by the Government of the Republic of Armenia.
The size of the cumulative amount of national pension and surcharge cannot exceed 100 percent of rate of official pay rate, stipulated in Clause 75 Judicial codes of the Republic of Armenia on the last post as the judge.
Recalculation of the amount of surcharge is made:
1) in case of recalculation of the size of national pension;
2) in case of increase in rate of official pay rate, stipulated in Clause 75 Judicial codes of the Republic of Armenia on the last post as the judge.
In case, stipulated in Item 2 parts 4 of this Article, recalculation of the amount of surcharge it is made in proportion to increase in rate of official pay rate. The procedure for recalculation of the amount of surcharge is established by the Government of the Republic of Armenia.".
