About modification and amendments in the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002
The Parliament adopts this organic law.
In the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes and additions:
1. Add the code with Article 127-1 of the following content:
"Article 127-1. Person protected by international humanitarian law
As person protected by international humanitarian law it is understood:
a) within the international armed conflict: any person protected by the Geneva conventions on protection of the victims of war of August 12, 1949 and the Additional protocol I concerning protection of the victims of the international armed conflicts of June 8, 1977, in particular patients, wounded, persons, castaway, prisoners of war and civilians;
b) within not international armed conflict: any person protected by the general clause of 3 Geneva conventions of August 12, 1949 and the Additional protocol II concerning protection of the victims of not international armed conflicts of June 8, 1977 (patients, wounded, persons, castaway, persons which are not directly involved in military operations which are under the power of the enemy party);
c) within the international or not international armed conflict: members of armed forces and combatants of the enemy party who laid down arms or for any reason have no more remedies and are not under the power of the enemy party.".
2. State Article 130 in the following edition:
