1. Identification of the foreign citizen who illegally is in the territory of the Russian Federation and who does not have the valid identity document and also in other cases, stipulated by the legislation the Russian Federation or the international treaty of the Russian Federation, is performed at the initiative of federal executive body in the field of migration or its territorial authority or according to the statement of the foreign citizen for identification.

Identification of the foreign citizen is performed based on the decision of the head of federal executive body in the field of migration or its territorial authority according to the procedure determined by this Article.
