About modification and amendments in some normative resolutions of the Supreme Court of the Republic of Kazakhstan

Due to the change of the legislation of the Republic of Kazakhstan the plenary session of the Supreme Court of the Republic of Kazakhstan decides:

1. Make changes and additions to the following normative resolutions of the Supreme Court of the Republic of Kazakhstan:

1-1. Ceased to be valid according to the Normative Resolution of the Supreme Court of the Republic of Kazakhstan of 29.06.2017 No. 5

1-2. Ceased to be valid according to the Normative Resolution of the Supreme Court of the Republic of 24.12.2014 No. 4

1-3. "About practice of pronouncement of private resolutions by courts on criminal cases" of December 19, 2003 No. 11 (with changes and additions made by the normative resolution of the Supreme Court of the Republic of Kazakhstan of December 22, 2008 No. 18):

To exclude 1) in Item 3 of the word "and courts";

To exclude 2) in Item 5 of the word "or when considering the case by subordinate court", and the words "Item 6 of article 446-8 Code of Criminal Procedure" shall be replaced with words "Item 8 of article 446-8 Code of Criminal Procedure";

3) to add the normative resolution with Item 15-1 of the following content:

"15-1. According to part 4 and part 5 of article 59 Code of Criminal Procedure, the Supervisory Court in case of establishment of the circumstances specified in article 387 Code of Criminal Procedure issues the private decree which is performed according to part 6 of article 448 Code of Criminal Procedure.".
