About introduction of amendments to some orders of the Ministry of Justice of Ukraine concerning realization of distrained property
According to Item 5 of the Section I of the Law of Ukraine of October 02, 2012 No. 5405-VI "About modification of some legal acts of Ukraine concerning accomplishment of economic obligations", Articles 43, 44 Laws of Ukraine "About mortgage" ORDER:
1. Paragraph two of Item 3.1 of Section 3 of the Procedure for realization of the distrained property approved by the order of the Ministry of Justice of Ukraine of July 15, 1999 No. 42/5, registered in the Ministry of Justice of Ukraine on July 19, 1999 for No. 480/3773 (with changes) to state in such edition:
"Amount of remuneration for the provided services in realization of distrained property shall not exceed taking into account the expenses connected with the organization and carrying out realization of property, and the value added tax of 15 percent from property value. At the same time the expenses connected with the organization and carrying out realization of property shall not exceed 5 percent of realization value of property. If the property is realized at the price, higher from starting, the specialized organization performs recalculation of remuneration in proportion to increase in the price of property and specifies in the protocol of auction the amount of remuneration which the buyer shall pay in addition, and also the account of the specialized organization on which it is necessary to pay these means".
