About modification of the Maritime Code of the Azerbaijan Republic

Being guided by Item 23 of part I of article 94 of the Constitution of the Azerbaijan Republic, Millie decides Majlis of the Azerbaijan Republic:

In the Maritime Code of the Azerbaijan Republic (Meeting of the Azerbaijan Republic, 2001, No. 7, Article 444; 2006, No. 12, Article 1029; 2007, No. 5, Article 442, No. 6, Article 562, No. 8, Article 756; 2009, No. 12, Article 948; 2010, No. 3, Article 171) to make the following changes:

1. add Article 2 with Articles 2.9 and 2.10 of the following content:

"2.9. Flag control - the state supervision in the field of check and the certification of the courts registered in the corresponding ship register of the Azerbaijan Republic and floating under national flag of the Azerbaijan Republic, including provision of documents by it concerning safety and environmental protection.

2.10. Port control - the state supervision on check of compliance of the foreign vessels which are coming into ports of the Azerbaijan Republic or leaving them, their equipment and management to requirements of international treaties.".

2. add with Article 5-1 of the following content:

"Article 5-1. Licensing in the field of merchant shipping

5-1.1. The following types of activity in the field of merchant shipping are performed on the basis of the corresponding permission (license):

5-1.1.1. transportation of goods by water transport;

5-1.1.2. transportation of passengers by water transport.".

3. add with Article 6.1.1.21 of the following content:

"6.1.1.21. Issue of the Certificate on insurance or other financial provision in connection with the civil responsibility for the damage caused as a result of pollution by bunker fuel.".

4. to state the text of Article 15 in the following edition:

"15.1. Engineering supervision over the courts specified in Article 16.2 of this Code, and their classification are performed by the classification societies chosen as the owner of the vessel and (or) the owner of the vessel.
