About modification and amendments in the Code of penal procedure of the Republic of Tajikistan
Article 1. Bring in the Code of penal procedure of the Republic of Tajikistan accepted by the Law of the Republic of Tajikistan of December 3, 2009 (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2009, No. 12, Art. 815; Art. 816; 2010, No. 7, Art. 551; 2011, No. 3, Art. 159; No. 7-8, of Art. 609; The Law of the Republic of Tajikistan of April 16, 2012, No. 809), the following changes and amendments:
1. Regarding 3rd Article 79 of the word "the case provided by part 2 of this Article" shall be replaced with words "the cases provided by part 2 of this Article, parts 3 and 4 of article 185 of this Code".
2. To add part 1 of article 80 after the words "Physical evidences" with words ", and also samples of the physical evidences provided by part 5 of article 185 of this Code".
3. To state part 5 of Article 185 in the following edition:
"5. In cases of suspension of pretrial investigation on criminal cases about illicit trafficking in drugs and psychotropic substances in large or especially large sizes on the bases provided by paragraphs to the first and second part 1 of article 230 of this Code based on the resolution of the investigator and with the consent of the prosecutor, with obligatory participation of the specialist and witnesses using video and photography, from the lump of physical evidences for familiarizing to criminal to case samples respectively in the amount of at least initial limit of large or especially large sizes of the drugs and psychotropic substances provided in appendix of 1 Criminal code of the Republic of Tajikistan are withdrawn. The rest of drugs and psychotropic substances is destroyed according to the legislation of the Republic of Tajikistan and according to the procedure, established by the Government of the Republic of Tajikistan.".
Article 2. Enact this Law after its official publication.
