About modification and amendments in the Law of the Republic of Tajikistan "About production and safe handling of pesticides and agrochemicals"
Article 1. Bring in the Law of the Republic of Tajikistan of April 22, 2003 "About production and safe handling of pesticides and agrochemicals" (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2003 t., No. 4, Art. 131; 2007, No. 5, Art. 368) following changes and amendments:
1. To add part one of Article 11 with the paragraph the fourth the following content:
"ensuring privacy of the materials arriving on environmental assessment;".
2. The fourth Article 22 to exclude part.
3. Add Chapter IV with Article 24 (1) the following content:
"Article 24 (1). Protection of confidentiality of information containing data on pesticides and agrochemicals
For the purpose of protection of the confidential information containing data on pesticides and agrochemicals, its owner has the right to take measures for protection of confidential information, and also procedure for its disclosure to the third parties.
Confidentiality of the classified information containing information on pesticides and agrochemicals is established by its owner provided that this information is:
for limited use is also not well-known;
has commercial value.
The mode of confidential information is set according to the legislation of the Republic of Tajikistan on trade secret.".
Article 2. Enact this Law after its official publication.
