Article 1. Bring in the Code of civil procedure of the Republic of Belarus of January 11, 1999 (The national register of legal acts of the Republic of Belarus, 1999, No. 18-19, 2/13; 2003, No. 133, 2/995; 2008, No. 5, 2/1404; No. 14, 2/1412; No. 172, 2/1473; 2010, No. 183, 2/1718) following amendment and change:
1. Add Article 6 with part five of the following content:
"The interested person shall observe procedure for preliminary extrajudicial permission of case if according to legal acts of the Republic of Belarus for collection in indisputable procedure for sums of money (debt) from the debtor making by the notary of executive text, and also is provided in other cases provided by legal acts of the Republic of Belarus.".
2. State Article 394 in the following edition:
"Article 394. Concept of mandative production
Mandative production is production according to the statement for collection of sum of money or reclamation of personal estate from the debtor without carrying out judicial session and challenge of the parties in cases if:
1) the requirement is based on notarially certified transaction, the transaction which except for is notarially certified based on which there is obligation on payment of money;
2) the requirement about collection of the alimony for minor children is declared, but it is not connected with establishment of motherhood and (or) paternity or need of involvement of the third parties for participation in case;
