About entering of amendments into some legal acts
The Parliament adopts this organic law.
Art. I. - In the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, No. 7274, of the Art. 195), with subsequent changes to make the following additions:
1. Part (Article 98 to add 2) with the Item b 1) of the following content:
"b 1) chemical castration;".
2. Add the code with Article of 1041 following contents:
"Article 1041. Chemical castration
(1) To persons who made the acts provided by the penal statute, encroaching on sexual immunity of other person, including minor, degree of jurisdiction according to parts (2) - (4) such security measure as chemical castration can be applied.
(2) Chemical castration as security measure is applied by degree of jurisdiction without fail for making of the crimes provided by Items a) and b) parts (3) Article 171 and Item a) parts (3) Articles 172, regardless of the imposed primary punishment.
(3) Chemical castration can be applied by degree of jurisdiction for making of crimes, stipulated in Item a) parts (2) and Items c) - f) parts (3) Articles 171, Item a) parts (2) and the Items a 1) - e) parts (3) Article 172.
(4) Chemical castration is performed by medical institutions together with penal institutions according to the Provision approved by the Government in the last three months of serving sentence after entry into force of conviction.".
Art. II. - In the Executive code of the Republic of Moldova No. 443-XV of December 24, 2004 (repeated publication: The official monitor of the Republic of Moldova, 2010, No. 214-220, of the Art. 704), with subsequent changes to make the following additions:
1. Add Article 174 with part (31) the following content:
"(31) Judgments on application of chemical castration are performed by medical institutions together with penal institutions in compliance with the Provision approved by the Government.".
2. Add the code with article 2911 of the following content:
"Article 2911. Application of chemical castration
