About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. - In part (2) article 71 of the Family code No. 1316-XIV of October 26, 2000 (The official monitor of the Republic of Moldova, 2001, No. 47-48, of the Art. 210), with subsequent changes, words "to life and health of the child," shall be replaced with words "to life, health or immunity of the child,".
Art. II. - In the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, No. 7274, of the Art. 195), with subsequent changes to make the following changes and additions:
1. Part (Article 174 to state 1) in the following edition:
"(1) Sexual connection, other than the rape, acts of vaginal, anal, oral or other penetration made concerning person which obviously did not reach 16 years are punished by imprisonment for a period of 3 up to 7 years.".
2. State Article 175 in the following edition:
"Article 175. Dissolute actions
The dissolute actions made concerning person which obviously did not reach 16 years consisting in eksgibition, obscene touches, conversations of obscene or cynical content about the sexual relations, inducement to participation or presence at pornographic performances, provision of materials of pornographic content and also in other actions of sexual nature
are punished by imprisonment for a period of 3 up to 7 years.".
3. Add the code with Article of 1751 following contents:
"Article 1751. Contacts with children in the sexual purposes
The offer, including by means of information technologies and means of communication, meeting with the child for the purpose of making concerning it any crimes of sexual nature if the offer was followed by the material actions conducting to such meeting is punished by imprisonment for a period of 1 year up to 5 years.".
4. Part (Article 206 to add 3) with the Item e 1) of the following content:
"e 1) made concerning the child who was under guardianship, protection, protection on education or treatment at the guilty person;".
