Article 1

Bring in the Federal constitutional Law of June 23, 1999 N 1-FKZ "About public vessels of the Russian Federation" (The Russian Federation Code, 1999, N 26, Art. 3170; 2006, N 50, Art. 5277; 2009, N 26, Art. 3119; N 52, of Art. 6401; 2010, N 18, Art. 2141) following changes:

Part 3 of Article 1 to state 1) in the following edition:

"3. Military courts are created and abolished by the Federal Law. No military court can be abolished if the matters carried to its maintaining were not at the same time referred in jurisdiction of other court. The number of judges of public vessels is established by the Supreme Court of the Russian Federation within the total number of judges of the Supreme Court of the Russian Federation and judges of other federal courts of the general jurisdiction established by the Federal Law on the federal budget for the next financial year and planning period.";

2) in Article 7:

a) add with part 2.1 following of content:

"2.1. If cases on the crimes committed by the group of persons, group of persons by previous concert organized by group or criminal society are jurisdictional to military court concerning at least one of accomplices, and allocation of criminal case concerning other persons is impossible, the specified cases in the relation of all persons are considered by the relevant military court.";

b) parts 3, 5 and 6 to recognize invalid;

c) add with part 6.1 following of content:

"6.1. Military courts are competent to make the decisions provided by parts two and third Article 29 of the Code of penal procedure of the Russian Federation on the cases referred to their cognizance.";

d) recognize part 7 invalid;
