About introduction of amendments to articles 19 and 43 of the Law of Ukraine "About labor protection"
The Verkhovna Rada of Ukraine decides:
I. Bring in the Law of Ukraine "About labor protection" (Sheets of the Verkhovna Rada of Ukraine, 2003, No. 2, the Art. 10) such changes:
1. Third of Article 19 to state part in the following edition:
"For the companies, irrespective of patterns of ownership, or physical persons which according to the legislation use wage labor expenses on labor protection constitute at least 0,5 of percent from the salary fund for previous year".
2. State Article 43 in the following edition:
"Article 43. Penalties against legal entities and physical persons which according to the legislation use wage labor, officials and workers
For violation of the law about labor protection and failure to carry out of instructions (orders) of officials of executive bodies on supervision of labor protection legal entities and physical persons which according to the legislation use wage labor are attracted by executive bodies on supervision of labor protection before payment of penalty according to the procedure, established by the law. Payment of penalty does not exempt legal entity or physical person which according to the legislation uses wage labor, from elimination of the revealed violations in certain terms.
The maximum size of penalty cannot exceed pyatiya of percent of average monthly salary fund for previous year of legal entity or physical person which according to the legislation uses wage labor.
For violation of the requirements provided by parts three and the fourth article 19 of this Law, legal entity or physical person which according to the legislation uses wage labor pays penalty at the rate of 25 percent from difference between estimated minimum amount of expenses on labor protection in the accounting period and actual amount of these expenses for such period.
