About introduction of amendments to articles 64.1 and 77 of the Federal law "About Mortgage (Pledge of the Real Estate)" and the Federal Law "About Accumulative and Mortgage System of Housing Providing the Military Personnel"

Bring in the Federal Law of July 16, 1998 No. 102-FZ "About mortgage (pledge of the real estate)" (The Russian Federation Code, 1998, No. 29, Art. 3400; 2002, No. 7, Art. 629; No. 52, Art. 5135; 2005, No. 1, Art. 42; 2007, No. 50, Art. 6237) following changes:
1) Article 64.1 to add with Item 3 following of content:
"3. The parcel of land acquired with use of accumulatings for housing providing the military personnel presented under the agreement of target housing loan according to the Federal Law "About Accumulative and Mortgage System of Housing Providing the Military Personnel" is considered being in pledge from the moment of state registration of the property right of the borrower to this parcel of land. In case of use of credit (loan) means of bank or other organization this parcel of land is considered being in pledge (mortgage) at the corresponding creditor and at the Russian Federation on behalf of the parcel of land of the federal executive body providing functioning of accumulative and mortgage system of housing providing the military personnel which granted target housing loan on acquisition.
At the same time the mortgage for the purpose of the certificate of the rights of the Russian Federation according to the obligation provided with mortgage is not issued. In case of stay in pledge of the parcel of land at the same time at the corresponding creditor and at the Russian Federation requirements of the Russian Federation are met after satisfaction of requirements of the specified creditor.";
