Chapter 1. General provisions

Article 1. Tasks of the Copyright law and related rights

This Law governs the relations connected with creation and use of works of spheres of science, literature, arts (copyright), execution, soundtracks, transfers of the broadcasting organizations (related rights).

Article 2. Legal regulation of the public relations developing in the field of copyright and the related rights

The public relations developing in the field of copyright and the related rights are regulated by the Constitution of the Republic of Armenia, the Civil code, this Law, other laws and legal acts.

Article 3. International agreements of the Republic of Armenia

If in international treaties of the Republic of Armenia other regulations are established, then these regulations are applied.

Article 4. The basic concepts used in the Law

In this Law the following basic concepts are used:

the author - physical person of which creative activity the work is result;

the audiovisual work - number of the images connected among themselves (with soundtrack or without it) which it is possible to see, and with soundtrack - and to hear. The cinema and expressed by similar means other works (television movies, videos, filmstrips, movies, etc.) are considered as the audiovisual work;

decompiling of the computer program - transformation of object code of the program to the source text;

the exclusive right - is lawful to use the right of the owner of property rights to result of intellectual activities this intellectual property item at discretion in any form and in any manner. Use by other persons of intellectual property items is allowed only with the consent of the owner of exclusive right. The owner of exclusive right can transfer the property rights belonging to it to other person fully or partially;

the contractor - the actor (theater, cinema, etc.), the singer, the musician, the conductor, the dancer or other person who plays role, sings, recites, reads, plays musical instrument, performs works of art or literatures, circus, doll, cabaret and other similar shows;

the collective work - the work created by two persons or more on initiative and under responsibility of physical person or legal entity;

the counterfeit copy - work copy, production or distribution of which involves copyright violation or the related rights;

the owner of copyright and (or) the related rights (person having rights) - the author or the contractor given property rights, physical person or legal entity to which property rights are yielded or which was given property rights;

transfer (program) of the broadcasting organization - set of live execution or the written-down material provided for distribution containing images and (or) sounds or other information created by the radio or cable broadcasting organization or - by its order and for its means - other organization;

the work - the result of the original creative activity performed by the author independently or together with other authors in the fields of science, literature or art, expressed in certain objective form;

the producer of the first record of execution or audiovisual works - physical person or legal entity, on initiative and under which responsibility the first record of any execution, the audiovisual work or sounds in the form of soundtrack, video or audiovideo is performed;

public - great number of persons who are not belonging to regular circle of family or relatives irrespective of whether there are they at the same time at one place or at different times at different places;

the public performance - submission of the work, execution, soundtrack, transfer of the broadcasting organization by means of the recitation, games, singing, dance or other means and methods as is direct (live execution), and by means of any devices and processes in places where such representation can be perceived without the need for implementation of the public message provided by the paragraph the nineteenth this Article and where there are present or can be persons which are not belonging to regular circle of family or relatives irrespective of whether there are they at the same time at one place or at different times at different places;

public performance of the audiovisual work - demonstration of images of the work in their sequence (including with reproduction of the sounds accompanying it);
