According to the Law of the Republic of Kazakhstan of June 20, 1997 "About provision of pensions in the Republic of Kazakhstan" the Government of the Republic of Kazakhstan decides:

1. Approve enclosed:

1) Rules of determination of the monthly income accepted for calculation of voluntary professional pension contributions;

2) the List of professions of workers for benefit of which investors at the expense of own means perform voluntary professional pension contributions.

2. This resolution becomes effective from the date of signing.

Rules of determination of the monthly income accepted for calculation of voluntary professional pension contributions

1. These rules of determination of the monthly income accepted are developed for calculation of voluntary professional pension contributions according to the Law of the Republic of Kazakhstan of June 20, 1997 "About provision of pensions in the Republic of Kazakhstan" and determine procedure for determination of the monthly income accepted for calculation of voluntary professional pension contributions in the accumulation pension funds.

2. Physical persons and legal entities (further - investors) estimate the income accepted for calculation of voluntary professional pension contributions proceeding from the amount of imputed income of the worker in month.

3. In case of calculation of voluntary professional pension contributions income of the worker gained in work payment type in cash and natural form is considered: official pay rates (tariff charges), surcharges, allowances, compensation payments, awards.

4. In case of calculation of voluntary professional pension contributions the following payment types are not considered:

1) the compensation payments connected with operating mode and working conditions:

payments according to the legislation of the Republic of Kazakhstan on social protection of the citizens who were injured owing to ecological disaster or nuclear testing on the test nuclear test site;

field allowances of workers, busy at exploration, land and prospecting works in field conditions, in the sizes established by the legislation of the Republic of Kazakhstan;

in cases when permanent job proceeds in transit or traveling nature or in connection with office trips within the serviced sites, in the sizes established by the legislation of the Republic of Kazakhstan has payments;

2) compensations paid by the employer to workers for unused labor leave;

3) compensations paid in case of termination of the individual employment contract in cases of liquidation of the organization or the termination of activities of the employer, reducing number of staff of workers or in case of the worker's appeal on military service in the sizes established by the legislation of the Republic of Kazakhstan.

5. Voluntary professional pension contributions are performed by investors at the expense of own means for benefit of workers according to the List of professions.

6. The rate of voluntary professional pension contributions is established by agreement of the parties the pension provision agreement at the expense of voluntary professional pension contributions, but no more than ten percent from the income of the worker.
