Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure of advanced training, training and retraining of workers.

2. Recognize to invalid:

Regulations on procedure of advanced training, training and retraining of workers

Chapter 1. General provisions

1. This Provision developed according to the Law of the Republic of Belarus of October 29, 1991 "About education" in edition of the Law of the Republic of Belarus of March 19, 2002 (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1991, No. 33, Art. 598; The National register of legal acts of the Republic of Belarus, 2002, No. 37, 2/844), Article 2201 of the Labor code of the Republic of Belarus, other legal acts of the Republic of Belarus, is regulated procedure of advanced training, training and retraining of heads and specialists of the organizations (further - workers).

2. Advanced training, training and retraining of workers are performed for the purpose of:

ensuring effective organization activity and industries of economy;

fillings of the labor market by heads and specialists with the high level of professional qualification and competence, general culture;

ensuring personnel support of innovative processes;

requirements satisfaction of workers in professional enhancement.

3. The basic principles of implementation of advanced training, training and retraining of workers are:

systemacity;

scientific character;

prospects;

orientation to employee development as persons;

individualization and differentiation of educational process;

combination of advanced training, training and retraining to self-education.

4. Advanced training, training and retraining of workers are performed in organizations of education (divisions of the organizations of education) providing advanced training and retraining of personnel (further - organizations (their division) which procedure for activities is determined by Regulations on organization of education (division of organization of education) providing advanced training and retraining of personnel, the approved resolution of Council of Ministers of the Republic of Belarus of January 24, 2008 to No. 103 (The national register of legal acts of the Republic of Belarus, 2008, No. 30, 5/26706).

The training of workers can be also performed in other organizations irrespective of their subordination and pattern of ownership.

Organizations (their division) have the right to perform activities for advanced training and retraining of workers in the presence at them special permissions (licenses) for implementation of the specified educational activities.

5. Advanced training and retraining of the managerial personnel of state bodies and other state organizations are performed according to the Regulations on the organization of work with the managerial personnel in system of state bodies and other state organizations approved by the Presidential decree of the Republic of Belarus of July 26, 2004 No. 354 "About work with the managerial personnel in system of state bodies and other state organizations" (The national register of legal acts of the Republic of Belarus, 2004, No. 120, 1/5712).

6. The workers undergoing retraining and advanced training are listeners.

The workers passing training are trainees.

Chapter 2. Advanced training

7. Advanced training belongs to additional education and provides deepening of professional knowledge and skills of workers at appropriate levels of the got earlier main education and is confirmed by the certificate on advanced training of the established sample.

8. Advanced training of workers is performed as required, but at least once in 5 years.

9. Duration of advanced training of workers constitutes from 1 to 2 weeks.

Total quantity of hours by the curriculum - from 36 to 80 class periods.

10. For separate employee categories duration and total quantity of hours by the curriculum of advanced training are established by the Ministry of Education in coordination with the Ministry of Finance, the Ministry of Labour and Social Protection, the Ministry of Economics.

11. The number of listeners in the groups trained at the expense of budgetary funds - 25-30 people.

12. Under the organization of advanced training of workers whose professional activity is connected with safety and health protection of people and also has other features (the small number of workers in the republic, advanced training of the workers having the highest achievements in professional activity, and others), the decision of state body under which supervision the organization (its division) is, approved with the Ministry of Education, the Ministry of Finance, the Ministry of Labour and Social Protection another interested the fullness of educational groups of the listeners studying at the expense of budgetary funds can be reduced.

13. Completing of educational groups can be performed by organization from number of persons employed of identical or different positions with the identical or different level of the main education depending on the purpose and content of training.

Chapter 3. Retraining

14. Retraining belongs to additional education, provides new qualification of the corresponding profile of education at the levels of the higher and secondary vocational education and is confirmed by the diploma about retraining of the established sample.

15. The list of specialties and qualifications on which retraining of workers is performed is determined by the Ministry of Education and the State committee on standardization in coordination with the Ministry of Labour and Social Protection and the Ministry of Economics.

16. The total quantity of hours by the curriculum of retraining shall be for listeners:

with the higher education - at least 1000 class periods;

with secondary vocational education - at least 600 class periods.

17. In cases when listeners have the main education as the same direction of education with specialty of retraining of personnel, reduction of total quantity of hours for listeners can be provided in curricula:

with the higher education - at least 500 class periods;

with secondary vocational education - at least 300 class periods.

18. Training duration when retraining constitutes for:

heads - up to 5 months in education presentia;

specialists with the higher education - to 18 months in presentia of education and up to 24 months in absentia education;

specialists with secondary vocational education - to 7 months in presentia of education and up to 9 months in absentia education.

19. The number of listeners in the educational groups studying at the expense of budgetary funds - 25-30 people.

20. On specialties of retraining of workers which future professional activity is connected with safety and health protection of people or other features and working conditions, the decision of state body under which supervision the organization (its division) providing retraining on these specialties approved with the Ministry of Education, the Ministry of Finance, the Ministry of Labour and Social Protection another interested fullness of educational groups of the listeners studying at the expense of budgetary funds is it can be reduced.

21. Retraining does not give the higher or secondary vocational education in retrainings.

Chapter 4. Training

22. Main objective of training is development by the worker of new methods, technologies and elements of professional activity, other achievements directly in the organization where they arose or are applied.

23. When holding the training of workers provided by legal acts of the Republic of Belarus for occupation of certain positions, regulations of this provision are not applied.

24. The training can be both independent type of training, and part of the curriculum in case of advanced training and retraining.

25. The training of specialists is performed:

in presentia can also proceed up to 5 months;

in absentia - up to 8 months.

26. Duration of training of workers determined in Item 25 of this provision is established by the organization directing the worker in coordination with the organization where the training, proceeding from its purposes and content is held.

In cases when the training is part of the curriculum in case of advanced training of workers, it can be lasting up to 1 week, when retraining - up to 3 weeks.

Chapter 5. Procedure for the organization of advanced training, training and retraining of workers

27. Advanced training, training and retraining of workers are performed both in the territory of the republic, and beyond its limits according to the legislation of the Republic of Belarus and within international agreements.

28. Advanced training and retraining of workers in organizations (their divisions) is carried out based on curricula, training programs, educational and thematic plans to which general requirements, and also procedure for their development and approval are determined by the Ministry of Education.

29. Passing of training is performed according to the individual training programs developed and approved by the organization directing to training in coordination with the head of that organization where it is carried out.

30. Advanced training and retraining of listeners come to the end with final assessment which procedure for carrying out is determined by the Ministry of Education.

31. In case of successful passing of final assessment by results of advanced training or retraining listeners receive the document of the established sample: the certificate on advanced training (in case of total quantity of hours by the curriculum at least 36 hours) or the diploma about retraining.

32. The training comes to the end with the report of the worker to the direct head on place of employment in the form of the analytical report or methodical recommendations about use in practice of the gained theoretical and practical knowledge, protection of the project or other form.

33. Advanced training, training and retraining of the workers directed to training by republican state bodies by the state organizations subordinated to the Government of the Republic of Belarus, the local executive and administrative organs, other state organizations financed from republican or local budgets are performed at the expense of means republican or the local budgets and other sources which are not prohibited by the legislation.

Financing of expenses on advanced training and retraining of the workers directed by the agricultural and other organizations performing production and conversion of agricultural products, separate divisions of the legal entities performing business activity on production of agricultural products and also the peasant farms and the organizations servicing agricultural industry is made at the expense of republican or the local budgets and other sources which are not prohibited by the legislation.

Advanced training, training and retraining of employees of other organizations are performed at the expense of own means of these organizations, and also means of the physical persons and other sources which are not prohibited by the legislation.

Chapter 6. Powers of state bodies and organizations for ensuring advanced training, training and retraining of workers

34. Public administration in the field of advanced training and retraining of workers is performed by the Council of Ministers of the Republic of Belarus, the Ministry of Education, the Ministry of Labour and Social Protection, other republican state bodies and the state organizations subordinated to the Government of the Republic of Belarus, local executive and administrative organs according to powers, heads of the organizations and organizations (their divisions).

35. The Council of Ministers of the Republic of Belarus determines the main directions of state policy in system of advanced training, training and retraining of personnel.

36. Ministry of Education:

realizes state policy in the field of advanced training, training and retrainings of workers, makes offers on the directions of their development;

provides organizational and scientific and methodical management with system of advanced training, training and retraining of workers;

provides project development of regulatory legal acts in the field of advanced training, training and retrainings of workers, standard curricula and programs of retraining;

issues to organizations of education special permissions (licenses) for implementation of educational activities for advanced training and retraining of workers with the higher and secondary vocational education;

performs the state accreditation and certification of organizations of education (their divisions), and also the state control of content and quality of educational process in all types of organizations (their divisions).

37. The Ministry of Labour and Social Protection establishes single qualification requirements to positions of employees which determine contents of curricula and training programs of advanced training and retraining of workers.

38. The republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus:

within the competence perform work on planning and the organization of advanced training, training and retraining of workers of industries, improvement of quality of training and effectiveness;

create industry systems of advanced training and retraining of workers, create network of the relevant organizations (their divisions);

perform measures on scientific methodically, to staffing and strengthening of educational material resources of system of advanced training, training and retraining of workers of industries;

provide compliance of content of training in requirements of scientific and technical and social and economic development of industries, the differentiated approach to the organization of work on advanced training, training and retraining of workers taking into account real desires and interests of different employee categories;

develop and approve the industry regulatory legal acts regulating questions of advanced training and retraining of workers taking into account specifics of their professional activity;

send workers to the organizations on training for the purpose of studying of experiment in the priority directions of production, training of workers in the field of management, science, the equipment and technologies;

pursue personnel policy in industry taking into account passing by workers of advanced training, training and retraining.

39. Local executive and administrative organs:

within the competence perform organizational and methodical management of system of advanced training and retraining of workers at the regional level taking into account features of regions and perspectives of their social and economic development;

within the competence perform work on planning and the organization of advanced training, training and retraining of workers;

pursue personnel policy in the region taking into account passing by workers of advanced training, training and retraining;

provide financing and strengthening of educational material resources of the organizations providing advanced training and retraining of workers of the region.

40. Heads of the organizations:

provide compliance of skill level of workers to requirements of scientific and technical and social and economic development of the republic, to conditions of development of production and needs of citizens;

determine needs of workers for advanced training, training and retraining;

sign agreements and perform the direction of employees of the organizations (sending) on advanced training, retraining and training to the relevant organizations (their division) and other organizations;

provide needs of workers for continuous professional improvement, create conditions for moral and financial incentive of their training.

41. Organizations (their division):

together with republican state bodies, local executive and administrative organs, the organizations develop and realize plans of advanced training, training and retraining of workers taking into account requirements of modern level of social and economic development of the republic and requests of citizens;

create and strengthen educational material resources, acquire technical means of training, education and visual aids, will organize development of educational and methodical materials;

provide quality of the provided educational services in advanced training, training and retraining of workers;

constantly update content, forms and training methods;

carry out the permanent analysis of quality of education, on its basis adjust and enhance educational activities;

will organize work on retraining, advanced training of pedagogical employees of organizations (their divisions);

provide consulting and methodical maintenance of implementation in practice of new knowledge, the abilities received by workers in the course of advanced training, training and retraining in organizations (their divisions), forming of new experience of their professional activity;

study, generalize and extend the best practices of work.
