1. These rules are developed in compliance of article 13 of the Law of the Republic of Tajikistan "About the competition and restriction of monopolistic activities in the goods markets", for the purpose of determination of the dominant position of business entities in the corresponding goods market applied in case of hearing of cases about violations of the law of the Republic of Tajikistan "About the competition and restriction of monopolistic activities in the goods markets" (further - the Law).
2. For the purposes of implementation of the Law the dominant position is understood as the exclusive provision of business entities or several business entities in the market of the goods which do not have substitute or interchangeable goods (further - certain goods) giving them the chance to exert the address of goods solving impact on general terms in the corresponding goods market or to complicate access to the market to other business entities.
Dominating provision also the provision of business entities whose share in the market of certain goods constitutes fifty percent and more is recognized unless the business entity will prove that, despite exceeding of the specified size its market position is not dominating.
