About practice of consideration of the applications according to the procedure of mandative production
For the purpose of ensuring the correct and uniform application of the legislation by economic courts of the Republic of Belarus by hearing of cases according to the procedure of mandative production, and also in connection with entry into force of the Economic Procedure Code of the Republic of Belarus in edition of the Law of the Republic of Belarus of August 6, 2004 "About modification and amendments in the Economic Procedure Code of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2004, the No. 138-139, 2/1064) Plenum of Supreme Economic Court of the Republic of Belarus, being guided by Articles 74, 75 Codes of the Republic of Belarus about judicial system and the status of judges (The national register of legal acts of the Republic of Belarus, 2006, No. 107, 2/1236).
DECIDES:
1. Explain to economic courts of the Republic of Belarus (daleekhozyaystvenny court) that mandative production is independent type of economic legal proceedings in Trial Court on consideration of the applications about money recovery or about the address of claim to property of the debtor which is performed in the simplified procedure regulated by Chapter 24 of the Economic Procedure Code of the Republic of Belarus (further - HPK).
2. Article 220 HPK provides the list of requirements according to which determination about the writ can be taken out.
