About modification and amendments in the joint order of the Minister of Energy of the Republic of Kazakhstan of December 24, 2015 No. 748 and the Minister of national economy of the Republic of Kazakhstan of December 29, 2015 No. 824 "About approval of criteria for evaluation of risk degree and checking sheets in the field of gas and gas supply"
WE ORDER:
1. Bring in the joint order of the Minister of Energy of the Republic of Kazakhstan of December 24, 2015 No. 748 and the Minister of national economy of the Republic of Kazakhstan of December 29, 2015 No. 824 "About approval of criteria for evaluation of risk degree and checking sheets in the field of gas and gas supply" (it is registered in the Register of state registration of regulatory legal acts at No. 13031) the following changes and amendments:
in Criteria for evaluation of risk degree in the field of the gas and gas supply approved by the specified joint order:

"3) the subject of control – producers commodity, liquefied oil, liquefied natural gas, the subsoil users who are owners of the commodity gas made in the course of conversion of the sour gas extracted by them, owners of the liquefied oil gas made in the course of conversion belonging to them on the property right or other legal causes of hydrocarbonic raw material, owners of the liquefied oil gas made outside the territory of the Republic of Kazakhstan and imported for consumption and (or) further realization, owners of the commodity gas made outside the territory of the Republic of Kazakhstan and imported for consumption on the territory of the Republic of Kazakhstan, owners of commodity gas made outside the territory of the Republic of Kazakhstan from the sour gas extracted in the Republic of Kazakhstan based on international treaties of the Republic of Kazakhstan, the national operator, owners of gas-filling stations, gas-distributing the organizations, gas transmission the organizations, owners of gas-filling Items, owners of autogas-filling stations, owners of autogas-filling compressor stations, owners of group reservoir installations, industrial consumers of commodity gas, industrial consumers of the liquefied oil gas, the industrial consumers investors, consumers included in the list of power plants;";
13) to be reworded as follows the subitem:
"13) industrial consumer – the individual entrepreneur or the legal entity acquiring gas for use in fuel quality and (or) raw materials in industrial and agricultural production.
The household consumers acquiring commodity gas whose limit of accounting of consumption of commodity gas exceeds sixty five cubic meters an hour also treat industrial consumers;";
22) to be reworded as follows the subitem:
"22) the consumer – the residential, household, industrial consumer, the industrial consumer investor or the consumer included in the list of power plants, the large commercial consumer, digital mayner;";
24) to be reworded as follows the subitem:
"24) the large commercial consumer – the legal entities regardless of the number of the gas-consuming equipment acquiring commodity gas of ten million cubic meters and more in year, except for the gas transmission and gas-distributing organizations using commodity gas for own needs including normative technical losses, and also consumers of commodity gas in the amount which is directly used for production:
socially important food products;
heat energy provided that such consumers are the subjects of natural monopolies providing regulated services in production of heat energy;
the electrical energy realized to the single purchaser of electrical energy according to the legislation of the Republic of Kazakhstan on power industry;
the electrical energy realized in the balancing market of electrical energy provided that such consumers are the power making organizations performing sale of electrical energy to the single purchaser of electrical energy according to the legislation of the Republic of Kazakhstan on power industry.
The provision of the paragraph of the fifth of part one of this Item does not extend to cases if the electrical energy realized in the balancing market of electrical energy is made by the power making organization, the agreement of transfer of responsibility for imbalances to the provider of balance who is provider of balance or signed according to the legislation of the Republic of Kazakhstan on power industry.";

1) results of monitoring of the reporting and the data represented by the subject of control to authorized body in the field of gas and gas supply;
2) results of the previous checks and preventive control with visit of subjects (objects) of control.";

2. In spheres of oil and gas of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to provide to department of the state control:
1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this joint order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;
3) within five working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan its direction in Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan for placement in the information system "Unified Register of Subjects and Objects of Checks".
3. To impose control of execution of this joint order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.
4. This joint order becomes effective after ten calendar days after day of its first official publication.
