About entering of amendments and changes into the Code of penal procedure of the Republic of Armenia

Article 1. In Article 196 of the Code of penal procedure of the Republic of Armenia (further - the code) of June 30, 2021:

Part 1 after the words "prosecutor" to add 1) with the words "in seven-day time";

Part 2 after the word "prosecutor" to add 2) with the words "in seven-day time".

Article 2. To state part 2 of article 197 of the Code in the following edition:

"2. In the case provided by part of 1 this Article the prosecutor exercising supervision takes out the decision on not initiation of criminal prosecution or the termination of criminal prosecution according to the petition of the investigator in seven-day time after receipt of the petition or on the initiative based on production materials.".

Article 3. To add part 1 of article 241 of the code with Item 7 of the following content:

"7) controlled deliveries and purchases.".

Article 4. To state part 3 of article 242 of the code in the following edition:

"3. Secret investigative actions can be carried out within production on the heavy or especially serious crimes, expected crimes connected with taking of a bribe or bribery, and controlled delivery and procurement can be conducted only within production on the crimes provided by part 2 of Article 251.1 of this Code.".

Article 5. In article 243 of the code:

To add 1) with part 4.1 following of content:

"4.1. Secret investigative action, stipulated in Item 7 parts of 1 Article of 241 of this Code, can be made:

1) concerning physical person concerning which there are facts testimonial of making of expected crime;

2) concerning the person accused;

3) concerning the legal entity concerning whom there is reasonable assumption that its activities completely or in the part relating to it are controlled, controlled or somehow actually goes person specified in Items 1 or 2 of this part.";
