About modification and amendments in the order of the Minister of Energy of the Republic of Kazakhstan of June 11, 2018 No. 233 "About approval of standard contracts on subsurface use"

I ORDER:

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of June 11, 2018 No. 233 "About approval of standard contracts on subsurface use" (it is registered in the Register of state registration of regulatory legal acts at No. 17140) the following changes and amendments:

to add Item 1 of the order with the subitem 6) of the following content:

"6) the standard contract on exploration and production of hydrocarbons on the subsoil plot located within the poorly studied territories according to appendix 6 to this order.";

to be reworded as follows Item 5 of the order:

"5. This order becomes effective since June 29, 2018 and is subject to official publication.

At the same time subitems 7), 8) and 9) of Item 44 of the standard contract on exploration and production of hydrocarbons given in appendix 1 to this order, subitems 7) 8) and 9) of Item 38 of the standard contract on hydrocarbon production given in appendix 2 to this order, subitems 7) 8) and 9) of Item 43 of the standard contract on exploration and production of hydrocarbons on difficult projects given in appendix 4 to this order, subitems 7) 8) and 9) of Item 34 of the standard contract on hydrocarbon production on difficult projects given in appendix 5 to this order, subitems 7) 8) and 9) of Item 51 of the standard contract on exploration and production of hydrocarbons on the subsoil plot located within the poorly studied territories given in appendix 6 to this order are effective till January 1, 2030.";

in the Standard contract on exploration and production of hydrocarbons approved by the specified order:

add Item 12 with subitem 5-1) of the following content:

"5-1) space borders of the subsoil plot requested for the purposes of increase in the subsoil plot by deepening of the lower space bound of the subsoil plot to five thousand meters without change of the closed contours (borders) on the land surface (in the territory of the subsoil plot) for the purposes of carrying out additional exploration of the lower horizons, are determined in coordination with authorized body in the field of studying of subsoil (regarding svobodnost of the required subsoil plot from subsurface use) according to the approved subsoil user and who received the positive decisions provided by the Code and other laws of the Republic of Kazakhstan of examinations by the project of mining (changes and amendments to it);";

add with Item of 21 following contents:

"21. The subsoil user shall carry out the work program containing types, amounts and terms of performance of works by years during investigation according to Appendix 1 to the Contract.";

2) of Item 22 to be reworded as follows the subitem:

"2) to perform financing of research, scientific and technical and (or) developmental works in the amount of one percent from the costs for production incured by the subsoil user during hydrocarbon production following the results of previous year according to the Rules of financing of research, scientific and technical and (or) developmental works in the amount of one percent from the costs for production incured by the subsoil user during hydrocarbon production following the results of previous year approved by the joint order of the Minister of Energy of the Republic of Kazakhstan of May 31, 2018 No. 222 and the Minister of Education and Science of the Republic of Kazakhstan of May 31, 2018 No. 244 (it is registered in the Register of state registration of regulatory legal acts at No. 17096);";

be reworded as follows Item 23:

"23. Purchase of goods, the works and services used when carrying out transactions on investigation or hydrocarbon production is performed by the subsoil user and his contractors, except for the subsoil users acquiring goods, works and services according to the legislation of the Republic of Kazakhstan on public procurements and also the legal entities having subsurface use rights, fifty and more percent of voting shares (shares) of which the national managing holding, according to Rules of acquisition by the subsoil users and their contractors of the goods, works and services used when carrying out transactions on investigation or hydrocarbon production, approved by the order of the Minister of Energy of the Republic of Kazakhstan of May 18, 2018 No. 196 directly or indirectly owns (it is registered in the Register of state registration of regulatory legal acts at No. 17122).";

"41. For the purpose of ensuring requirements of the domestic market with oil products subsoil users shall perform according to delivery schedules oil supply for conversion in the territory of the Republic of Kazakhstan, and in case of stop of oil refinery because of emergency - and beyond its limits.

2) ratio of the extracting and delivery wells on each operational object;

3) compensation coefficient on deposits;

4) relation of reservoir and bottomhole pressure to pressure of saturation or pressure of condensation;

5) relation of reservoir pressure to bottomhole pressure;

6) the most admissible size of gas factor on wells;

7) hydrocarbon production amounts;

8) amounts of the return downloading the working agent for increase in reservoir pressure;

9) indicators of input of operational wells.

At the same time measure values, specified in this Item, do not join in the Contract and are determined proceeding from project documents.";

in Item 98:

1) to be reworded as follows the subitem:

"1) for default on obligations of intra country value in goods, works and services - in the amount of 10% of the amount of obligations, unexecuted for the accounting period;";

3) to be reworded as follows the subitem:

"3) for non-execution or improper execution of the financial liabilities provided by the Contract - in the amount of 10% of the amount of the obligation, unexecuted for the accounting period;";

add with subitem 3-1) of the following content:

"3-1) for non-execution of the amounts and work types on the subsoil plot during investigation provided by the work program (extra works) to the Contract, - in the amount of 10% of the cost of outstanding amounts and work types for the accounting period of the obligation. At the same time if actual expenses of the subsoil user owing to the change in price, acting in the market, and also on other circumstances which are not depending on will of the subsoil user turned out less than that which were considered in case of the conclusion of the Contract, but at the same time the physical amount of the obligations of the subsoil user specified in Item 21 of the Contract is performed in full, such reduction of actual expenses of the subsoil user is not violation of contract obligations;";

7) to be reworded as follows the subitem:

"7) for not the direction or the untimely direction of notifications according to:

Items 29 and 31 of the Contract - in the amount of 5 000 MRP;

Items 20 and 30 of the Contract - in the amount of 2 000 MRP;

Item 32 of the Contract - in the amount of 100 MRP;";

in the Standard contract on hydrocarbon production approved by the specified order:

2) of Item 18 to be reworded as follows the subitem:

"2) to perform financing of research, scientific and technical and (or) developmental works in the amount of one percent from the costs for production incured by the subsoil user during hydrocarbon production following the results of previous year according to the Rules of financing of research, scientific and technical and (or) developmental works in the amount of one percent from the costs for production incured by the subsoil user during hydrocarbon production following the results of previous year approved by the joint order of the Minister of Energy of the Republic of Kazakhstan of May 31, 2018 No. 222 and the Minister of Education and Science of the Republic of Kazakhstan of May 31, 2018 No. 244 (it is registered in the Register of state registration of regulatory legal acts at No. 17096);";
