About change of resolutions of the Plenum of the Supreme Court of the Republic of Belarus

1. Make changes to the following resolutions of the Plenum of the Supreme Court of the Republic of Belarus:

1.1. in the resolution of the Plenum of the Supreme Court of the Republic of Belarus of March 26, 2003 No. 2 "About application of the legislation by courts in case of the dispute resolution, connected with the property right to premises":

in part one of item 4 of the word "Item 3 of Article 8" shall be replaced with words "part one of Item 3 of Article 9";

state Item 6 in the following edition:

"6. Draw the attention of courts that state registration of creation of premises, the rights to them and transactions with them is made by registrars of the organizations for state registration of real estate, the rights to it and transactions with it in the sequence, certain article 11 of the Law. The interested person believing that decisions, by actions (failure to act) of the registrar violate its rights and (or) legitimate interests has the right to appeal such decisions, actions (failure to act) in the republican organization for state registration of real estate, the rights to it and transactions with it and in court. Appeal judicially is performed after appeal of such decisions, actions (failure to act) in administrative (extrajudicial) procedure (article 47 of the Law).";
