About modification of some regulations (about the prevention and suppression of drug trafficking, narcotic, psychotropic substances, ethnobotanical means, precursors or analogs of narcotic or psychotropic substances)
The Parliament adopts this organic law.
Art. I. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:
1. In part (3) Article 208:
add disposition with Item with 1) of the following content:
"with 1) by involvement of the minor in making of one of the crimes provided by Articles 217-217-4 or 219;";
in the sanction of the word "from 3 to 7 years." shall be replaced with words "from 5 to 8 years.".
2. State Article 209 in the following edition:
"Article 209. Involvement of minors in illegal consumption of drugs, ethnobotanical means or analogs of narcotic or psychotropic substances
(1) Involvement of minors in illegal consumption of drugs, narcotic, psychotropic substances, ethnobotanical means or analogs of narcotic or psychotropic substances by person who reached 18 years
it is punished by penalty in the amount of 700 to 1000 conventional units, or unpaid work for benefit of society for a period of 140 till 180 o'clock, or imprisonment for a period of 3 up to 5 years.
(2) the Actions provided by part (1), committed:
a) using violence or with threat of its application;
b) two or more persons;
c) with use of official position;
d) in the territory of educational institutions, rehabilitation, penal institutions, military units, in vacation spots, venues of actions for education and training of minors or youth, other cultural or sporting events or in close proximity to such places,
are punished by unpaid work for benefit of society for a period of 180 till 240 o'clock, or imprisonment for a period of 3 up to 7 years with deprivation or without deprivation in both cases of the right to hold certain positions or to be engaged in certain activities for a period of 2 up to 5 years.
