About modification of some regulations (simplification of ministerial procedures on installation of photovoltaic systems, electric power storage systems, and also reduction in compliance of the regulatory base connected with National fund of development of system of regulating documents in construction)
The Parliament adopts this organic law.
Art. I. – In the town-planning and construction code No. 434/2023 (Official monitor of the Republic of Moldova, 2024, Art. No. 41-44, 61), with subsequent changes, to make the following changes:
1. In Article 44:
in part (shall be replaced with words 3-1) words of "the objects relating to engineering networks" "the objects relating to engineering networks including the infrastructure facilities intended for needs of safety and national defense, which are not confidential":
parts (3-4) and (3-5) to recognize invalid.
2. Add Article 55 with part (1-4) following contents:
"(1-4) If within the reconciliation procedure necessary for approval of documentation on town planning, the relevant organ or the organization/subject take out the negative conclusion, they shall provide the discrepancies revealed in documentation and violations with direct specifying of provisions of the legislation which were not observed. The beneficiary and the author (designer) assume liability to eliminate these discrepancies and violations in the time approved by the parties, and also after their elimination repeatedly to submit documentation to relevant organ or the organization/subject for issue of the conclusion. In case of repeated approval these bodies and organizations/subjects have no right to refer to other discrepancies or violations in addition to revealed within the initial procedure of issue of the conclusion, except as specified, when their elimination resulted in other discrepancies or violations or when other changes were made to repeatedly submitted documentation on town planning.".
