About modification of some regulations (assistance to creation of workplaces for the condemned persons)
The Parliament adopts this organic law.
Art. I. - Item 4 of article 36-1 of the Law on entrepreneurship and the companies No. 845/1992 (1994, No. 2, the Art. 33), with subsequent changes, to add the monitor of Parliament of the Republic of Moldova with the subitem l) the following content:
"l) employment of persons serving custodial sanction or persons exempted from places of detention within the first six months after release.".
Art. II. - In the Executive code of the Republic of Moldova No. 443/2004 (repeated publication: The official monitor of the Republic of Moldova, 2010, Art. No. 214-220, 704), with subsequent changes to make the following changes:
1. In part (Article 198 the word "for the first time" to exclude 1).
2. In Item i) parts (1) Article 205 of the word "without convoy or maintenance", shall be replaced with words "without maintenance outside penal institution,".
3. Add the code with Article 211-1 of the following content:
"Article 211-1. Personal account of the convict
(1) Each convict has personal account through which during serving sentence payment transactions according to legislation provisions are performed.
(2) the Money received for the work executed by the convict during serving sentence is transferred into its personal account.
(3) at the request of the convict pension, benefits or other social payments, and also the money received based on the judgment or inherited within heritable production can be transferred into its personal account.
(4) the Personal account can be replenished also from other sources, in addition to provided by parts (2) and (3).
(5) the Convict can list money from the personal account to the spouse/spouse, children, parents, and also other persons according to the law.
