About modification of some regulations (digitalization of some judicial processes)
The Parliament adopts this organic law.
Art. I. - Law on judicial system No. 514/1995 (repeated publication: 2013, Art. No. 15-17, 62), with subsequent changes to add the official monitor of the Republic of Moldova with Article 14-1 of the following content:
"Article 14-1. Access to data from information systems
For the purpose of the data acquisition and information necessary for implementation of the procedure of the direction of the agenda and other procedural acts, degrees of jurisdiction by means of platform of interoperability use access to necessary data from the databases and information systems managed by bodies of the public power and public organizations.".
Art. II. - In the Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 436), with subsequent changes to make the following changes:
1. In Article 100:
part (1-1) to state in the following edition:
"(1-1) Action for declaration and procedural acts of degree of jurisdiction are brought to the attention of bodies of the public power, the legal entities, individual entrepreneurs, persons performing legal activities, and the physical persons using the help of the lawyer by means of the Integrated management program cases to which they are connected by means of the e-mail address specified in the action for declaration, the document certifying powers on representation in court, or in other documents confirming its use and also to the e-mail address identified by means of government platforms, the State register of legal units and the State register of legal professions.";
add Article with part (1-2) following contents:
"(1-2) Procedural acts directed by means of electronic means are considered brought to the attention for date and time when they became available to the addressee in the information system used for communication.".
