The Parliament adopts this organic law.

Chapter I. General provisions

Article 1. Subject and scope of application

(1) This law regulates procedure for the organization and activities of arbitration.

(2) This law is applied if the place of arbitration is in the Republic of Moldova. Provisions of Articles 8, of 19, 20 and 48 are applied also if the place of arbitration is in other jurisdiction or is not established yet.

(3) If the place of arbitration is not determined yet, degrees of jurisdiction are authorized to perform the competences provided by Chapter III if the defendant or the claimant takes the location or the residence in the Republic of Moldova.

(4) If the international treaty which party is the Republic of Moldova establishes other provisions, than stipulated by the legislation in the field of arbitration, regulations of the international treaty are applied.

Article 2. Basic concepts and rules of interpretation

(The following basic concepts mean 1) for the purposes of this law:

1) arbitration - the alternative way of the dispute resolution performed by Arbitration Court;

2) the arbitral agreement - the agreement on the basis of which the parties submit to arbitration everything or part of disputes which arose or can arise between them in connection with certain legal relationship (contractual or non-contractual);

3) Arbitration Court - the single arbitrator or arbitral panel.

(2) If one of provisions of this law, except for Article provisions 38, grants to the parties power of decision on certain question, such right includes also the right of the parties to authorize the third party, including organization to make the relevant decision.

(3) If one of provisions of this law concerns to what the parties agreed about or can agree, or otherwise concerns their agreement, the relevant agreement includes any arbitral rules provided in its text.
