About modification of some regulations (strengthening and increase in efficiency of judicial system)
The Parliament adopts this organic law.
Art. I. - In the Law on National institute of justice No. 152/2006 (repeated publication: The official monitor of the Republic of Moldova, 2016, No. 387, of the Art. 789), with subsequent changes to make the following changes:
1. Add Article 19 with parts (2-1)-(2-3) of the following content:
"(2-1) Students of elementary training are provided with medical care within system of compulsory medical insurance on the conditions established by the Law on compulsory medical insurance No. 1585/1998, for the entire period of elementary training including the period of suspension of elementary training for health reasons.
(2-2) in case of the temporary disability confirmed with the leaf about medical leave issued in the procedure established by the law for the listener the grant in the amount of 60 percent for the entire period of suspension remains.
(2-3) Absence on rates of elementary training in the period of the temporary disability confirmed according to part (2-2), is not disciplinary violation, does not involve suspension of payment of grant, assignment or loss of the status of the listener, except as specified, directly provided by this law.".
2. Add the law with Article 19-1 of the following content:
"Article 19-1. Transition between categories of candidates for judgeship and the prosecutor
(1) No later than one month from the date of the publication of the order on transfer the student of elementary training has the right to submit the reasoned statement about transition from category of candidates for the prosecutor's position for category of candidates for judgeship or on the contrary.
(2) Transition is performed based on the order of the director within the number of places approved by Council for each category, in decreasing order on the GPA got by results of reception tender.
(3) After the term provided by part (1), change of category of candidates is not allowed.
(4) Transition does not attract change of the status of the listener, the size of grant and the period of the elementary training undergone until transition.".
