About introduction of amendments to the Electoral code No. 325/2022

The Parliament adopts this organic law.

Art. I. - In the Electoral code No. 325/2022 (Official monitor of the Republic of Moldova, 2022, Art. No. 426-427, 770), with subsequent changes, to make the following changes:

1. In Article 1:

state the concept "elections" of the following edition:

"elections - unless otherwise specified, elections to parliament (further also - parliamentary elections), to position of the President of the Republic of Moldova (further also - presidential elections), regional elections, elections to bodies of local public authority (further also - local elections), and also referenda;";

add the concept "nominated candidate" with the offer of the following content: "As candidates persons who in 70 days prior to the election day fall under concept of the independent candidate can be pushed by political parties and the electoral blocs, were not members of other political party, except that which pushed them, or political party, other than those which constitute the electoral bloc;";

after the concept "independent candidate" to add the code with concept of the following content:

"the camouflage independent candidate - person pushed as the independent candidate who is formal or informal directly or indirectly performs joint, approved or coordinated with political party or the electoral bloc of action, concerning the election campaign, financing, material logistics or pre-election messages, aiming either the investigation promotion of own candidate or bypass of legal limits concerning nomination of candidates by political forming;";

in the concept "certification of preparation/specialization in the selective sphere" of the word "knowledge and" to exclude;

after the concept "initiative group" to add the code with concept of the following content:

"remote identification of the voter with use of digital means - the process of identification and check of the identity of the voter based on the shown identification documents, the measurements of biometric parameters of person, comparison of the image and data transferred by the physical person and/or received from external data sources performed with use of digital means. Remote identification of the voter with use of digital means can be performed by means of the automated means of check without participation of the person operator or by check with participation of the person operator;";

after the concept "additional list of voters" to add the code with concept of the following content:

"the electoral register for vote by mail - the electoral register including voters who were registered previously underwent testing and have the right to vote by mail;";

after the concept "room of the polling precinct" to add the code with concept of the following content:

"alternative method of vote - the method of realization of the voting right according to provisions of this Code allowing the voter to vote otherwise than by physical presence on the polling precinct in the election day;";

after the concept "The State Automated Information System "Elections"" to add the code with concept of the following content:

"the hidden support of elective job seekers - any financial, material, organizational, material or media support provided directly or indirectly to the elective job seeker by political party or the electoral bloc if such support is performed from permission, consent or in case of coordination of the elective job seeker or persons, representatives to be effective from his name, and is directed to promotion of the elective job seeker bypassing the legal regime applicable to political parties or competitors on elections. Presence at structure of initiative group of the faces tied with political parties in case of failure of evidence of coordination or consent, in itself is not recognized the hidden support;";

after the concept "treasurer" to add the code with concept of the following content:

"vote by mail - alternative implementation method of the voting right abroad with use of post/courier services;".

2. Add Article 8 with part (2-1) following of content:

"(2-1) V departure from part provisions (1) vote is by mail performed till the election day according to provisions of this Code.".

3. Add Article 9 with part (3) the following content:

"(3) In departure from provisions of parts (1) and (2) the voting right can be also performed by means of alternative methods of vote according to provisions of this Code.".

4. Add the code with Article 14-1 of the following content:

"Article 14-1. The right to choose by mail

(1) by mail the persons listed in article 14 who sent request for their inclusion in the electoral register for vote by mail and included in this list have Rights to choose.

(2) For participation in vote also person which reached 18-year age no later than the election day by mail can be registered.".

5. In Article 16:

Item d) parts ("the decision or" to add 2) after words with the word which "became";

6. In part (Article 23 of the word "it can directly be appealed in Appeal chamber Chisinau" shall be replaced with words 4) "it is appealed directly in the Appeal Center chamber", in part (5) Article 91 and Item 2) parts (Article 98 the word "Chisinau" to replace 1) with the word "Center".

7. Part (articles 24 after words of "new local elections" to add 1) with words ", regional elections".

8. In Article 25:

Item c) to add with words ", including those which concern implementation and the organization of alternative methods of vote";

in Item x) words "Marine life protection act of personal data No. 133/2011;" shall be replaced with words "The marine life protection act of personal data No. 195/2024;";

add Article with Items z) - z 2) of the following content:

"z) approves regulations on the organization and carrying out vote by means of alternative methods of vote;

z 1) establishes features of implementation and use of alternative methods of vote;

z 2) carries out monitoring of observance of safety requirements, integrity and the confidentiality shown to alternative methods of vote.".

9. Add Article 27 with Item w) the following content:

"w) renders assistance in the organization and carrying out regional elections and exercises supervision of them, and also issues resolutions on the actions performed according to provisions of this Code.".

10. Part (Article 28 to add 1) with Item 17) of the following content:

"17) People's Assembly of Gagauzia - carrying out consultations concerning setting a date of regional elections.".
