About modification of the Natural Gas Act No. 108/2016
The Parliament adopts this organic law.
Art. I. - In the Natural Gas Act No. 108/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 193-203, 415), with subsequent changes, to make the following changes:
1. In Article 85-1:
part (to state 5) in the following edition:
"(5) the Subject on supply with natural gas shall create and support inventories of natural gas for providing covering at least 15 percent of the annual average consumption of natural gas by final consumers determined for the last five calendar years in the Dnestr region where unlicensed system operators perform activities. In case of determination of annual average consumption of natural gas by final consumers the Agency considers only amount of the natural gas consumed for covering of own needs of final consumers of the Dnestr region without the consumption intended for production of the electrical energy delivered out of region limits.".
part (to add 6) with the offer of the following content: "Inventories of natural gas are created gradually, till November 1, according to the schedule established by the resolution of the Agency.".
part (to state 7) in the following edition:
"(7) Due to the obligation fulfillment, provided by part (5), the subject on supply with natural gas has the right to delegate discharge of duty on storage to other traders and/or suppliers of natural gas licensed in the Republic of Moldova and/or in other member countries of Energy community, and/or in member states of the European Union. Delegation of obligation on storage does not exempt the subject on supply with natural gas from liability for non-execution, inadequate or untimely discharge of duty on storage, and also the accompanying obligations established by this Article. Inventories of natural gas are created and supported with observance of provisions of parts (1), (2) and (4) Article 108-3.".
