About modification of some regulations (protection of the child and execution of judgments on implementation of the parent rights)
The Parliament adopts this organic law.
Art. I. - In the Family code No. 1316/2000 (Official monitor of the Republic of Moldova, 2001, Art. No. 47-48, 210), with subsequent changes, to make the following changes:
1. Add Article 37 with part (41) the following content:
"(41) If the action of rescission of scrap is made because of violence in family, the degree of jurisdiction at the request of the victim addresses the legal aid coordinator of territorial bureau of National council guaranteed by the state about assignment of counsel for provision of the legal aid guaranteed by the state.".
2. Part (Article 58 to add 1) with words ", except as specified, when the degree of jurisdiction limited for certain period the parent's right to communication with the child because of violence in family".
3. Part (Article 60 to add 1) with words ", except as specified, when the degree of jurisdiction limited for certain period the parent's right to communication with the child because of violence in family".
4. 64, 65 and 73 to state Articles in the following edition:
"Article 64. Implementation of the parent rights by the parent living separately from the child
(1) in case of separate accommodation of parents the parent together with whom the child lives cannot interfere with implementation of the parent rights by the parent living separately, including maintenance of the regular personal relations and direct contact with the child, except as specified, when the contact was limited or suspended according to the law for certain period, and maintenance of contact contradicts the highest interests of the child or threatens life, health or development of the child.
