About state regulation of organic production, the address and marking of organic products

This Law determines the basic principles and requirements to organic production, the address and marking of organic products, feature of the state control of observance of requirements in this sphere operators of the market, in particular operators of the market of organic products, groups of operators of the market of organic products, and establishes responsibility for violation of the legislation in the field of organic production, the address and marking of organic products.

Section I. General provisions

Article 1. Determination of terms

1. In this Law terms are used in the following value:

1) audit of authorized body of certification in the field of organic production and/or turnover of organic products - check which is carried systematically out by the Central executive body realizing state policy in the field of safety and separate indicators of quality of foodstuff for the purpose of determination of compliance to the planned actions of activities and results of activities of authorized body of certification in the field of organic production and/or the address of organic products on implementation of separate actions of the state control and other official actions in the field of organic production, the address and marking of organic products, and also determination of efficiency and effectiveness of realization of such actions;

2) withdrawal from turnover of products - the measures directed to prevention of distribution, demonstration or the offer to consumers of products marked as organic, or products marked as products of transition period, in case of detection of the discrepancy influencing authenticity of products, or in the absence of the certificate certifying compliance of production process of products and/or its address to requirements of the legislation in the field of organic production, the address and marking of organic products, and/or the foreign certificate that certifies compliance of production process of products and/or its address to requirements of other legislation in the field of organic production and/or the address of organic products, than the legislation of Ukraine;

3) production division assets of economy, in particular the parcels of land, pastures, zones in the open air, rooms or parts of rooms for farm animals, beehives, fish ponds, constructions for seaweed or animals of aquaculture, and also capacity (including capacities on which primary production is performed and/or capacities for storage of raw materials, the made products, entrance products and substances) on which production of organic products or production of transition period, or production of inorganic products is performed;

4) production division of the transitional period - production division in which the operator of the market of organic products or group of operators of the market of organic products performs activities during transition from inorganic production to organic production with observance of requirements of the legislation in the field of organic production, the address and marking of organic products;

5) production cycle - lifecycle of animal of aquaculture or alga from the earliest stage of life (for animal of aquaculture - the impregnated caviar) before catching or cleaning respectively;

6) the entering products and substances - products and substances which are used by the operator of the market of organic products, group of operators of the market of organic products according to the legislation in the field of organic production, the address and marking of organic products, but are not made on capacities of the operator of the market of organic products, group of operators of the market of organic products;

7) generation - group of the plants constituting single stage in the heritable line of plants;

8) the hydroponic production method is method of cultivation of plants without soil in case of which roots of plants are located in mineral nutritious solution or on inert environment, such as perlite, gravel or mineral wool to which nutritious solution is added;

9) economy - all production units which are under single management for the purposes of cultivation of live animals, production of the agricultural products and/or products which are closely connected with agricultural industry not subject to conversion in addition to essential oils and yeast;

10) group of operators of the market of organic products (further - group of operators) - the legal entity formed by physical persons, physical persons - entrepreneurs and/or legal entities irrespective of form of business which signed the contract on carrying out certification of production and/or turnover of products with authorized body of certification in the field of organic production and/or turnover of organic products also conforms to the requirements determined by this Law;

11) the state logo for organic products designation which is used for marking (representation, advertizing) the organic products made according to requirements of the legislation in the field of organic production, the address and marking of the organic products bearing the graphical representation and inscription matching the technical description;

12) the State register of youth of organic animals of aquaculture (further - the register of organic animals of aquaculture) - the information and communication system providing collection, accumulating, protection, accounting, display, processing of register data and provision of register information on youth of organic animals of aquaculture;

13) the State register of operators of the market of organic products and groups of operators of the market of organic products (further - the register of operators) - the information and communication system providing collection, accumulating, protection, accounting, reflection, processing of register data and provision of register information concerning operators of the market of organic products and groups of operators;

14) the State register of organic animals (further - the register of organic animals) - the information and communication system providing collection, accumulating, protection, accounting, display, processing of register data and provision of register information of rather organic animals;

15) the State register of organic landing material and landing material of transition period (further - the register of organic landing material) - the information and communication system providing collection, accumulating, protection, accounting, reflection, processing of register data and provision of register information of rather organic landing material and landing material of transition period (except seedling, but including seed potatoes);

16) the State register of authorized bodies of certification in the field of organic production and the address of organic products (further - the register of authorized bodies of certification) - the information and communication system providing collection, accumulating, protection, accounting, reflection, processing of register data and provision of register information of rather authorized bodies of certification in the field of organic production and/or the address of organic products;

17) precaution measure measures which are taken by the operator of the market of organic products, group of operators on each production stage and addresses of organic products, products of transition period for prevention of pollution by other products and substances, than permitted to use in the course of organic production, and prevention of mixing of organic products, products of transition period with inorganic products;

18) ingredient - any substance or product, including nutritional supplements, fragrances and food enzymes, and any component of complex ingredient which are used for production of the foodstuff or product which is not food and which remain in ready-made product even in the changed form;

19) ingredient of agricultural origin - the ingredient received from agricultural products;

20) the foreign certificate certifying compliance of production process of products and/or its address to requirements of other legislation in the field of organic production and/or the address of organic products than the legislation of Ukraine (further - the foreign certificate), - the document issued by body of foreign certification in the field of organic production and/or the address of organic products, certifying compliance of production and/or the address of organic products, products of transition period to requirements of other legislation in the field of organic production and/or the address of organic products than the legislation of Ukraine;

21) the inspector on certification of organic production and/or the address of organic products (Further - the certification inspector) - the physical person conforming to requirements, the established this Law received the certificate on ownership of special knowledge in the field of organic production, the address and marking of organic products and signed the employment contract with certification body in the field of organic production and/or the address of organic products;

22) other official actions in the field of organic production, the address and marking of organic products (further - other official actions) - activities, except the state control, the performed central executive body realizing state policy in the field of safety and separate indicators of quality of foodstuff and/or authorized bodies of certification in the field of organic production and/or the address of organic products within the powers conferred according to this law including issue of the certificate certifying compliance of production process of products and/or its address to requirements of the legislation in the field of organic production, the address and marking of organic products, provision of consent to application of exceptions of requirements to organic production, carrying out formal investigation in the field of organic production addresses and markings of organic products (further - formal investigation);

23) qualification examination - verification of presence at person who intends to receive the certificate on ownership of special knowledge in the field of organic production, the address and marking of organic products, special knowledge in the field of organic production, the address and marking of organic products, including rather corresponding category (the corresponding categories) of organic products;

24) competent authority - the central executive body realizing state policy in the field of safety and separate indicators of quality of foodstuff;

25) maternal plant - the plant intended for reproduction of complete organism of plant;

26) discrepancy - non-compliance (violation) with the market of organic products by the operator, group of operators of requirements of the legislation in the field of organic production, the address and marking of organic products;

27) inorganic products - products received as a result of inorganic production;

28) inorganic production - the production which is not meeting the requirements of the legislation in the field of organic production, the address and marking of organic products;

29) inorganic production division - production division in which perform inorganic production;

30) inorganic ingredient - the ingredient received as a result of inorganic production;

31) turnover of products as organic or as products of the transitional period realization and/or storage of products marked as organic products or as products of transition period, for the purposes of realization, including the offer to realization and/or other forms of transfer, in particular electronic commerce, distribution irrespective of, perform them on paid or non-paid basis;

32) the operator of the market of organic products (further - the operator) - the person (physical person, the physical person - the entrepreneur or the legal entity) which is performing production and/or turnover of products according to requirements of the legislation in the field of organic production, the address and marking of organic products and signed the contract on carrying out certification with authorized body of certification in the field of organic production and/or the address of organic products;

33) body of foreign certification in the field of organic production and/or the address of organic products (further - body of foreign certification) - the legal entity irrespective of form of business who is carrying out certification of organic production and/or the address of organic products according to requirements of other legislation than the legislation of Ukraine;

34) certification body in the field of organic production and/or the address of organic products (further - certification body) - the legal entity irrespective of form of business accredited in the field of organic production and/or the address of organic products according to the Law of Ukraine "About accreditation of conformity assessment bodies";

35) the organic products products received as a result of organic production (except products received during transition period), or products recognized as organic products on customs area of Ukraine according to this law;

36) the organic selection selection which is carried out in the conditions of organic production on the basis of natural reproductive capability, agronomical indicators, indicators of resistance to diseases and adaptation to local soil and climatic conditions, directed to increase in genetic variety;

37) organic production - the certified activities connected with production, performed with observance of requirements of the legislation in the field of organic production, the address and marking of organic products, in particular the activities performed during transition period;

38) organic production division - production division in which the operator or group of operators performs activities with observance of requirements of the legislation in the field of organic production, the address and marking of organic products, except activities during transition period;

39) organic heterogeneous material set of plants within one botanical taxon of the most low known rank, representing general phenotypical characteristics, is characterized by the high level of genetic and phenotypical variety of separate reproductive units, is not grade or mix of grades and is grown up according to requirements of the legislation in the field of organic production, the address and marking of organic products;

40) organic ingredient - the ingredient received as a result of organic production except the ingredient received during transition period;

41) the organic grade suitable for organic production, - the grade which is characterized by the high level of genetic and phenotypical variety of separate reproductive units and being result of organic selection;

42) stay under control of authorized body of certification in the field of organic production and/or turnover of organic products - the conclusion of the contract on carrying out certification with authorized body of certification in the field of organic production and/or the address of organic products or are subject to check of certification by authorized body in the field of organic production and/or the address of organic products in connection with provision of services according to the works agreement to the operator, group of the operators who signed the contract on carrying out certification with authorized body of certification in the field of organic production and/or the address of organic products;

43) the transitional period period of transition from inorganic production to organic production during which the operator or group of operators perform activities with observance of requirements of the legislation in the field of organic production, the address and marking of organic products;

44) preparation transaction on conservation or conversion of organic products, products of transition period or any other transactions which apply to products which are not subjected to conversion without change of its initial condition, including face, cutting, cleaning (washing), grinding, packaging and marking;

45) the crop production cultivation of plants connected with the soil in the soil, in particular in the soil mixed with the substances and products permitted to use in the course of organic production, or fertilized by such substances and products provided that such soil belongs to the transitional horizon or borders on maternal breed;

46) preventive measures measures which are accepted by the operator or group of operators on each production stage and turnover of organic products, products of transition period aimed at providing preserving biodiversity and quality of the soil, prevention of appearance of wreckers and diseases of plants, and also at prevention of negative impact on the environment, health of animals and condition of plants;

47) products - products determined by part two of article 2 of this Law;

48) products marked as organic, - products in which marking the state logo for organic products and/or the word "organic", "biodynamic", "biological", "ecological", "organik" and any single-root or derivative of them, in particular the word with prefixes "bio -" is used "эко -", etc. in any language;

49) products marked as products of transition period - products in which marking the specifying "products of transition period to organic production" is used;

50) the products received with use of genetically modified organisms are the products received with use in production process of one or several genetically modified organisms as the last live organism, but which are not genetically modified products;

51) products of the transitional period products received during transition period in which marking use of the specifying "products of transition period to organic production", or products recognized as products of transition period on customs area of Ukraine according to this law is authorized;

52) crop production products - products of plant origin, except the plants which were not exposed to conversion or had only simple training, such as crushing, drying or pressing;

53) traceability - possibility of identification and tracking of products, the products and substances intended for inclusion (what is expected will are included) in products, on all production stages and addresses;

54) retrospective start date of the transitional period - the start date of transition period of the parcel of land determined retrospectively taking into account the period preceding the beginning of implementation by the operator or group of operators of economic activity on such parcel of land with observance of requirements of the legislation in the field of organic production, the address and marking of organic products;

55) seedling - the young plant which is grown up from seeds for the subsequent change on the permanent place in the discovered or closed soil;

56) the certificate on ownership of special knowledge in the field of organic production, the address and marking of organic products document, issued by the central executive body, providing forming also realizes state policy in the field of organic production, the address and marking of organic products, to person who successfully passed qualification examination;

57) the certificate certifying compliance of production process of products and/or its address to requirements of the legislation in the field of organic production, the address and marking of organic products (further - the certificate), - the document certifying compliance of production and/or the address of organic products, products of transition period to requirements of the legislation in the field of organic production, the address and marking of organic products, issued by authorized body of certification in the field of organic production and/or the address of organic products to the operator or group of operators;

58) certification of organic production and/or the address of organic products (further - certification) - the procedure which is carried out by authorized body of certification in the field of organic production and/or the address of organic products which include check of compliance of production and/or the product circulation to requirements of the legislation in the field of organic production, the address and marking of organic products;

59) authenticity of organic products, products of transition period (further - authenticity of products) - lack of signs of discrepancy which influences characteristics of organic products, products of transition period at any stage of its production and/or the address or which is repeating or deliberate;

60) production stage and addresses of organic products, products of the transitional period - any stage of primary production, preparation, conversion, storage, transportation or realization of organic products, products of transition period, in particular markings, advertisings, import, export, including rendering services in the works agreement;

61) animal aquacultures - the aquaculture objects belonging to animals;

62) authorized body of certification in the field of organic production and/or the address of organic products (further - authorized body of certification) - certification body to which the competent authority conferred powers on implementation of separate measures of the state control and other official actions in the field of organic production, the address and marking of organic products for accomplishment of the functions determined by this Law;

63) the authorization provision competent authority of certification body of powers on implementation of separate measures of the state control and other official actions of organic products for accomplishment of the functions determined by this Law.

2. Other terms are used in this Law in the following values:

the term "operator of the market" - in the value determined in the Law of Ukraine "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health of animals and wellbeing of animals";

the term "grade" - in the value determined in the Law of Ukraine "About protection of the rights to plant varieties";

the terms "agricultural products", "producers of agricultural products" - in the values determined in the Law of Ukraine "About bases of the state agrarian policy and state policy of rural development";

other terms - in the values determined in the laws of Ukraine "About ministerial procedure", "About the basic principles and requirements to safety and quality of foodstuff", "About aquaculture", "About veterinary medicine and wellbeing of animals", "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health of animals and wellbeing of animals", "About safety and hygiene of forages", "About information for consumers concerning foodstuff", "About protection of the rights to plant varieties", "About seeds and landing material" and "About state regulation of genetic and engineering activities and the state control of placement in the market of genetically modified organisms and products".

Article 2. Coverage of this Law

1. This Law governs the relations connected with production, turnover, marking, import to customs area of Ukraine, in particular for the purpose of transit and export from customs area of Ukraine in export regime of organic products and products of transition period.

2. Operation of this Law extends to agricultural products, foodstuff and forages of agricultural origin which classify in groups 01-23 UKTVED if such products belong to one of the following categories:

1) live animals or agricultural products not subject to conversion, including seeds and landing material;

2) the agricultural products subjected to conversion, which are foodstuff;

3) stern.

Operation of this Law also extends to such products which are closely connected with agricultural industry:

the sweet corn classified in groups 07 and 20 according to UKTVED;

mat or the Paraguayan tea classified in commodity subcategory 0903 00 00 00 according to UKTVED;

the beeswax classified in commodity subcategory 1521 90 10 00 according to UKTVED;

the core of palm tree classified in commodity subcategory 2008 91 00 00 according to UKTVED;

the yeast suitable for use in the foodstuff and sterns classified in goods item of 2102 according to UKTVED;
