Chapter 1. General provisions

Article 1. Purpose and scope of this Law

The purpose of this Law is regulation of the relations in the field of development, uses of highways and road activities in the Republic of Uzbekistan (further - the sphere of highways).

This Law is applied to all highways in the Republic of Uzbekistan irrespective of pattern of ownership and value.

Article 2. Legislation on highways

The legislation on highways consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about highways are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

the highway - the object of transport infrastructure intended for continuous and safe movement of vehicles with established by the speed, loading and dimensions, the including parcel of land within strip of branch and structural elements on it or under it (the road basis, paving and others) road constructions, technical means of the organization of traffic;

reconstruction of the highway - complex of works on change of transport and operational indicators of the highway or its sites, including with change of its technical category, aimed at providing reliability, safety and comfort of the highway;

content of the highway - complex of works on maintenance in proper condition, to prevention and elimination of minor defects of the road, road constructions and strips of branch throughout the road within year, to the organization and safety of movement, and also winter content and improvement (gardening) of the road;

repair of the highway - complex of works on replacement and recovery of structural elements of the highway and road constructions, including to recovery of initial transport and operational properties of the road (to elimination of depreciation of covering, recovery and improvement of its flatness and coupling qualities of car tires with paving, to elimination of all deformations and damages), and also on increase in geometrical parameters of the road within standard rates for the repaired category of the road without increase in width of road bed throughout the road taking into account the perspective growth of traffic load and axial loadings of cars;

users of highways - legal entities and physical persons, being participants of traffic or performing the activities permitted in accordance with the established procedure within strip of branch and roadside strip;

owners of highways - republican executive bodies and executive bodies on places, physical persons and legal entities, in maintaining (ownership, use) or property of which there is highway;

branch strip - the parcel of land provided in permanent use in the procedure established by the legislation for placement of the highway, including its corresponding structural elements and engineering constructions, and also other constructions necessary for operation of the highway, creation of protective and decorative plantings;

the specialized road organizations - the legal entities who are carrying out works on repair and content of the highway based on the agreement signed in accordance with the established procedure with the owner of the highway or the operator;

objects of roadside infrastructure and service - the building, constructions and other objects intended for servicing of participants of traffic along route (gas stations and charging stations for electric vehicles, hotels, campings, motels, objects of trade and public catering, Items of delivery of health care, service station, toilets, and also the vacation spots necessary for participants of traffic, the parking lot of vehicles and other infrastructure facilities and service);

road constructions - artificial road constructions (bridges, overpasses, platforms, pipes, tunnels and other engineering constructions), protective road constructions (devices for protection of roads against avalanches, landslides, noise-protective, wind-shelter devices and other devices), elements of arrangement of highways (stopping platforms, pavilions for passengers, platforms of rest, the parking lot of vehicles, Items of collection of payment and others), and also the buildings and constructions relating to road divisions;

the road coupon - the payment document (the coupon, the sticker placed on the vehicle) for driving through the paid highway, and also the electronic document confirming the fact of implementation of payment of journey by automatic method including based on the state number of the vehicle, with use of the electronic technical device (the software, transponders);

road activities - activities for designing, construction, reconstruction, repair and content of highways, and also other works (services) necessary for implementation of the specified activities;

the operator - the legal entity to who the owner of the paid highway or according to the agreement on public-private partnership assigns obligations on repair, content and operation of the paid highway, and also on collection of payments and rendering other services to users of the paid highway;

the paid highway - the highway (the section of the highway) used on paid basis;
