According to Item of 1 part one of Article 7, article 30 of the Law of Ukraine "About state regulation of the capital markets and the organized goods markets", the Law of Ukraine "About institutes of joint investment" and for the purpose of enhancement of the legislation on activities for joint investment the National commission on securities and the stock market

SOLVED:

1. In preamble of the decision of the National commission on securities and the stock market of November 19, 2013 No. 2605 "About approval of the Regulations on procedure for the termination of mutual investment fund", the word registered in the Ministry of Justice of Ukraine on December 17, 2013 at No. 2128/24660, and figure "According to Item 3 parts one and Item 30 parts two of Article 7, of Items 13 and 23 of article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine" shall be replaced with words also in figures "According to Item of 1 part one of article 7 of the Law of Ukraine "About state regulation of the capital markets and the organized goods markets".

2. Registered on December 17, 2013 at No. 2128/24660, to be reworded as follows the regulations on procedure for the termination of mutual investment fund approved by the decision of the National commission on securities and the stock market of November 19, 2013 No. 2605, the Ministry of Justice of Ukraine which is applied.

3. To provide to department of methodology submission of this decision on state registration in the Ministry of Justice of Ukraine.

4. To provide to management of administrative activities promulgation of this decision on the official website of the National commission on securities and the stock market.

5. After state registration of the decision by the Ministry of Justice of Ukraine to provide to department of legal development publication of this decision on the official website of the National commission on securities and the stock market.

6. This decision becomes effective from the date of, its official publication following behind day.

7. Control over the implementation of this decision to assign to the member of the National commission on securities and the stock market A. Ilyin.

Regulations on procedure for the termination of mutual investment fund

I. General provisions

1. This Provision determines the procedure of the termination of mutual investment fund (further - Fund), the sequence of actions and organizational actions which need to be performed for: decision makings about liquidations of Fund, preparation and carrying out such liquidation, including implementation of settlings with members of Fund, cancellation of registration of release (releases) of investment certificates of Fund, the prospectus (prospectuses) of issue of investment certificates of Fund and cancellation of the certificate (certificates) on registration of release (releases) of investment certificates of Fund, exception of information about Fonda of the State register of issues of securities and of the Unified state register of institutes of joint investment (further - the Register), and also considerations of NKTsBFR of the statements and documents provided by this Provision on the termination of Fund.

2. In this Provision the provided terms are used in the following values:

the applicant - the chairman of liquidation commission Fonda or the authorized person of the company on asset management of Fund in case the Fund is liquidated without creation of liquidation commission which files in NKTsBFR petition for cancellation of registration of release (releases) of investment certificates of Fund, the prospectus (prospectuses) of issue of investment certificates of Fund and cancellation of the certificate (certificates) on registration of release (releases) of investment certificates of Fund and/or the statement for exception of information about Fonda of the Register;

keeper of assets Fonda:

for Fund with public placement - depositary organization bank, having the license for activities granted by NKTsBFR on storage of assets of institute of joint investment and with which in the procedure established by the legislation the company on asset management signs the service agreement by the keeper of assets of Fund;
