The purpose of this Law is regulation of the relations in the field of the indemnification caused by illegal decision, action or failure to act of state body or its official.
This Law is applied to the relations arising in case of indemnification, caused by illegal decision, action or failure to act of state bodies, their structural and territorial subdivisions or officials.
Procedure for the indemnification caused by illegal actions or failure to act of employees of National guard of the Republic of Uzbekistan, law-enforcement bodies, customs authorities and military personnel and also notaries of offices of notary public, procedure for indemnification to persons injured with carrying out counter-terrorist operation, in case of elimination of emergency situations, as a result of the circumstances which formed the basis for introduction of emergency state or in connection with application of measures for suppression of similar circumstances or to elimination of their effects, and also procedure for the indemnification caused in connection with seizure of land for social needs with compensation payment are established by the separate laws.
The legislation on indemnification, the caused illegal decision, action or failure to act of state body or its official, consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan determines other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about indemnification, the caused illegal decision, action or failure to act of state body or its official, apply rules of the international treaty.
