About town-planning renovation

The purpose of this Law is regulation of the relations in the field of town-planning renovation.
Operation of this Law does not extend to the relations in the field of procedures of seizure of land for social needs for compensation and the redemption of the parcels of land which are private property, repair and restoration of objects of material cultural heritage, and also the organization of the territories of new arrays on the empty parcels of land.
The legislation on town-planning renovation consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about town-planning renovation are applied rules of the international treaty.
In this Law the following basic concepts are applied:
re-planning of the parcels of land - change of territorial zones of the settlements provided in the master plan of the settlement and the draft of the detailed layout within the project of renovation;
the owner - physical person or legal entity, being the owner of the rights to real estate objects located in the territory of town-planning renovation, and owning the parcels of land on right of lifetime inheritable possession, permanent use, lease (except for the sublease rights), property or on other type of the right provided by acts of the legislation;
mass assessment - assessment which is periodically performed by the state for the purpose of cost determination of real estate objects, close to their market value;
the project of renovation - the document representing the document package including the feasibility statement, technical and economic calculations and detailed project decisions, developed in the territory of town-planning renovation according to the master plan of the settlement, the draft of the detailed layout taking into account processes of urbanization;
the concept of the project of renovation - the document reflecting the original project form created as a result of planning of implementation of town-planning renovation of the parcel of land and the objects of residential and non-residential category located on it in the territory of town-planning renovation;
the third parties are the physical persons who are not living constantly in the territory of town-planning renovation, either the investors or the construction organizations which expressed desire to implement the project of renovation;
town-planning documentation - the approved documents on town-planning development planning of the territories and settlements and on their building;
town-planning renovation - package of measures, directed to architectural, social, economic and ecological improvement of the territory according to the project of renovation developed based on town-planning documentation and also to reduction of the buildings located in this territory, constructions in suitable for accommodation and operation, convenient and energy efficient condition, including on their effective use and re-planning of the parcels of land;
the program of town-planning renovation - the official document about renovation project implementation approved according to this Law the decision of republican council on coordination of implementation of town-planning renovation or territorial councils on implementation of town-planning renovation in which specific purposes and the tasks are set for contractors specific project deadlines of renovation are determined;
the territory of town-planning renovation - the territory having clear boundary based on the project of renovation, provided in the program of town-planning renovation;
the circumstances which are seriously influencing social life of the population of the territory - the circumstances providing re-planning of the parcels of land taking into account availability of risks of ecological, technogenic or natural disasters, life-threatening the populations in certain territory, discrepancies to requirements of fire safety, neediness of engineering communications and objects of social infrastructure, and determined on this basis by the Cabinet of Ministers of the Republic of Uzbekistan;
the principle of vertical growth - vertical expansion of buildings, constructions from their initial condition taking into account processes of urbanization;
the agreement - the agreement signed between participants of the program of town-planning renovation (the state, the third parties and owners), including participation elements (partial participation) in town-planning renovation or compensation provisions.
The bases for implementation of town-planning renovation are:
moral and physical wear of the objects of residential and non-residential category located in the territory of town-planning renovation, their unfitness for accommodation and operation, receipt to critical condition;
availability of the circumstances which are seriously influencing social life of the population of the territory.
Main objectives of town-planning renovation are:
architectural, social, economic and ecological improvement of the territory on the basis of the project of renovation;
reduction worn-out, recognized unsuitable for the accommodation and operation which came to critical condition of housing stock in the condition suitable for accommodation and use by the person;
elimination of the circumstances which are seriously influencing social life of the population of the territory;
increase in convenience and efficiency of use of housing stock, and also improvement of conditions in it;
creation of the engineering communications and social infrastructure meeting the modern requirements, improvement of indicators of energy efficiency.
Town-planning renovation consists of the following types performed based on the project of renovation:
reconstruction of the existing object without change of the main design;
demolition of the existing object and construction of new object of the same category on the exempted parcel of land;
organization of green zones and other territorial zones.
Within the program of town-planning renovation one or several types of town-planning renovation provided by part one of this Article can be applied.
The offer on implementation of town-planning renovation can be made at the initiative of the following subjects:
at the initiative of the state;
at the initiative of owners;
at the initiative of the third parties.
The subjects initiating implementation of town-planning renovation according to article 46 of the Town-planning code of the Republic of Uzbekistan based on the approved comprehensive programs on implementation of master plans of settlements can make the offer on project implementation of renovation in renovation zones.
Town-planning renovation based on the approved comprehensive programs on implementation of master plans of settlements is performed in the following stages:
1) introduction of initiative of implementation of town-planning renovation:
a) at the initiative of the state:
development of the concept of the project of renovation;
holding general meeting of owners of each object and receipt of notarially certified written consent at least four fifth of them;
project development of renovation and corresponding calculations;
entering of the offer on implementation of town-planning renovation into Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and city of Tashkent;
b) at the initiative of owners:
the appeal to khokimiyat of the area (city) with the offer on implementation of town-planning renovation;
development of the concept of the project of renovation;
holding general meeting of owners of each object and receipt of notarially certified written consent at least four fifth of them;
entering of the offer on implementation of town-planning renovation into the relevant khokimiyat of the area (city);
