About modification of the Code of penal procedure of the Kyrgyz Republic

Bring in the Code of penal procedure of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:
1) in Article 142:
a) in part 1:
- the paragraph one to state in the following edition:
"1. The investigator, the judge, court has the right to allocate from criminal case in separate production another criminal case:";
- declare Item 2 invalid;
- add with Items 6 and 7 of the following content:
"6) concerning one or several persons accused in case of the conclusion them agreements on recognition of fault;
7) concerning the person accused if it is determined that the person accused made act in condition of diminished responsibility or ached after crime execution with mental disturbances.";
b) state parts 2 and 3 in the following edition:
"2. Allocation of criminal case is made under the resolution of the investigator, judge, court, determination of court. The list allocated in originals or copies of materials shall be attached to the resolution.
Copies of documents in the presence of their originals are subject to assurance. If in case papers there are only copies of documents without submission of originals, such copies are not subject to assurance.
3. Allocation of criminal case is allowed if it does not affect comprehensiveness and objectivity of criminal trial, including for completion of investigation of criminal case, in cases when it is caused by the large volume of criminal case or plurality of its episodes.";
c) regarding 4 words "criminal case file" and "criminal case file" to replace respectively with the words "criminal case" and "criminal case";
d) in part 6 of the word of "criminal case file" shall be replaced with words "criminal case";
To add 2) with Article 142-1 of the following content:
