About modification of some regulations (optimization of some procedures concerning nationality)
The Parliament adopts this organic law.
Art. I. - In the Law on nationality of the Republic of Moldova No. 253/2025 (The official monitor of the Republic of Moldova, 2025, Art. No. 498-501, 650) to make the following changes:
1. In Article 9:
in Item c) parts (the words "if the child corresponds to legal conditions for recognition by his face without nationality." shall be replaced with words 1) "if the child becomes the stateless person.";
add Article with parts (4) - (6) the following content:
"(4) Person recognized as the citizen of the Republic of Moldova owing to its birth of the law, applicable for date, which did not receive the documents proving the identity of the citizen of the Republic of Moldova before achievement of age by it 18 years had the right to petition for establishment of belonging to nationality of the Republic of Moldova according to the law.
(5) Belonging to nationality of the Republic of Moldova proves to be true if it is determined that on birth date person corresponded the established law to conditions for acquisition of nationality on the birth and did not lose the nationality according to Articles 21-22.
(6) If in case of consideration of the application about establishment of belonging to nationality of the Republic of Moldova availability of the bases for deprivation of nationality is established, the procedure of deprivation of nationality is initiated. Before completion of the procedure of deprivation of nationality issue of the document confirming belonging to nationality stops.".
2. In part (Article 10 of the word "if this person corresponds to legal conditions for recognition by his face without nationality." shall be replaced with words 6) "if this person becomes the stateless person.".
3. In part (3) Article 11 and part (4) Article 12 the second offer to state in the following edition: "The consent of the child is not required in cases when he would become the stateless person or when he is not capable to realize value of the actions.".
