About introduction of amendments to some laws of Ukraine concerning expansion of competence of international arbitration

The Verkhovna Rada of Ukraine decides:

I. Make changes to such laws of Ukraine:

1. In the Law of Ukraine "About the international commercial arbitration" (Sheets of the Verkhovna Rada of Ukraine, 1994, No. 25, Art. 198; with the changes made by the Law of Ukraine of June 19, 2020 No. 738-IX):

Item 2 of Article 1 to state 1) in the following edition:

"2. Can be transferred to the international commercial arbitration by agreement of the parties:

the disputes over contractual and other civil relations arising when implementing the foreign trade and other types of the international commercial ties if the commercial enterprise at least of one of the parties of dispute at the time of the conclusion of the arbitral agreement is abroad or if the parties obviously agreed that the subject of the arbitral agreement is connected more than with one state, or one of the following places is outside the state in which the parties have the commercial enterprises:

- the arbitration place if it is determined in the arbitral agreement or according to it;

- any place in which considerable part of the obligations arising from contractual or other civil relations shall be executed;

- the place with which the matter in issue is most closely connected;

disputes of the companies with foreign investments and the international associations and the organizations created in the territory of Ukraine, among themselves, disputes between their participants, and also their disputes with other persons of law of Ukraine;

disputes between the administrator over bond issue which acts for the benefit of bondholders according to provisions of the Law of Ukraine "About the capital markets and the organized goods markets" and bond issuing institution and/or persons who provide providing on such bonds if at least one of the parties of dispute is the company with foreign investments.
