Article 39.1. Agreement of housing savings
Under the agreement of housing savings one party (credit institution) shall accept to pay the money or money arriving for benefit of the investor from the third party arriving from other party (investor) interests on them, and also to return to the investor the amount of savings (money and percent on them) by the direction it according to the order of the investor including into other account other than the account on which money under the agreement of housing savings, for the purpose of payment of acquired premises or financing of individual housing construction is placed, participations in shared-equity construction according to the Federal Law of December 30, 2004 "About participation in shared-equity construction of apartment houses and other real estate objects and about modification of some legal acts of the Russian Federation" (further in case of joint mentioning - improvement of housing conditions) and to grant to No. 214-FZ the loan for improvement of housing conditions in case of the investor's compliance to the conditions determined by credit institution by consideration of the request for loan granting.
Under the agreement of housing savings only the physical person can be the investor. The term of attraction of the money arriving from the investor or for benefit of the investor from the third party within the agreement of housing savings cannot be less than three years.
