About modification of the Civil code of the Kyrgyz Republic

Article 1.

Bring in part II of the Civil code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1998, No. 6, the Art. 226) the following changes:

1) in Article 738-9:

a) state Item 1 in the following edition:

"1. Under the agreement of murabakh the bank having the corresponding license shall sell to the client by installments the goods bought by it according to the request of the client or which are in property of bank at the time of the address of the client taking into account the features provided by Articles 738-10 and 738-11 of this Code.";

b) declare Item 2 invalid;

Item 2 of Article 738-10 to state 2) in the following edition:

"2. The bank can sign the purchase and sale agreement as independently, and through the agent. As the agent the bank can appoint the client who acts on behalf and for bank account or on its own behalf, but for bank account according to the rules provided by Chapter 42 of this Code.

In case of appointment of the agent the bank shall observe the restrictions set by the legislation of the Kyrgyz Republic.";

Item 1 of Article 738-11 to state 3) in the following edition:

"1. Under the agreement of murabakh all transactions on purchase of the subject of the agreement of murabakh are made from bank name if other is not provided by the agency agreement.";

Item 3 of Article 738-12 to state 4) in the following edition:

"3. Before transfer of the subject of the agreement of murabakh to the client the bank bears all risks connected with damage, destruction or loss of the subject of the agreement of murabakh in transit or storage and such risks cannot be covered due to pledge.";
