About modification and amendments in some legal acts of the Republic of Kazakhstan concerning activities of special state bodies of the Republic of Kazakhstan

Article 10. Conditions and limits of use of physical force, office animals, special means, weapon, military and other equipment

1. Employees and (or) military personnel of Service of the state protection of the Republic of Kazakhstan have the right to use of physical force, office animals, military and other equipment, and also to carrying, storage and application of special means, weapon in all cases provided by the laws of the Republic of Kazakhstan.

2. In cases of justifiable defense and emergency or during detention of person who made offense the employee and (or) the serviceman of Service of the state protection of the Republic of Kazakhstan in case of absence at it special means or weapon has the right to use any make-shifts, and also on the bases and according to the procedure which are established by this Law, to use other weapon and other equipment which are not consisting on arms.

3. In the anti-terrorist operation zone the employees and (or) military personnel of Service of the state protection of the Republic of Kazakhstan who are involved in anti-terrorist operation have the right to use against terrorists physical force, office animals, special means, weapon, military and other equipment without the prevention and restrictions provided by this Law and other laws of the Republic of Kazakhstan.

4. Employees and (or) military personnel of Service of the state protection of the Republic of Kazakhstan shall have special training, recurring inspection on suitability to actions in the conditions connected using physical force, office animals, special means, weapon, military and other equipment.

5. In case of use of physical force, office animals, special means, weapon, military and other equipment employees and (or) military personnel of Service of the state protection of the Republic of Kazakhstan take necessary measures for safety of surrounding physical persons and first-aid treatment by the victim.

6. Use of physical force, office animals, special means, weapon, military and other equipment by employees and (or) the military personnel of Service of the state protection of the Republic of Kazakhstan with abuse of authority involves the responsibility established by the laws of the Republic of Kazakhstan.

7. The employee and (or) the serviceman of Service of the state protection of the Republic of Kazakhstan do not bear responsibility for the moral, material and physical harm done in connection with application in the cases of physical force provided by the laws of the Republic of Kazakhstan, office animals, special means, weapon, military and other equipment if protection corresponds to nature and danger of infringement of protected persons, the protected objects or the employee and (or) the serviceman of Service of the state protection of the Republic of Kazakhstan.
