About introduction of amendments to the law of the Azerbaijan Republic "About subsoil"
Millie Majlis of the Azerbaijan Republic, being guided by Item 11 of part I of article 94 of the Constitution of the Azerbaijan Republic, decides:
In the Law of the Azerbaijan Republic "About subsoil" (The collection of legal acts of the Azerbaijan Republic, 1998, No. 4, Article 224 (volume I); 2024, No. 3, Article 250) to make the following changes:
1. At the end of the seventh paragraph of the first part of article 7 to replace point with semicolon and to add the eighth paragraph of the following content:
"use of the deposits (sand, sand-gravel soil, clay) collected in reservoirs or reservoirs and also the rocks extracted from subsoil in connection with construction of tunnels or passes".
2. Under Article 13:
2.1. to add to the second part I the third offer of the following content:
"The procedure for provision of subsoil for use by direct negotiations is determined by body (organization) appointed by relevant organ of the executive authority".
2.2. Add the eighth and ninth parts of the following content:
"Rules of holding actions for enhancement of activities of the land users who are engaged in development of fields of nonmetallic minerals are determined by the body (organization) appointed by the relevant executive body.
Land users are granted the right to use waste of mining activities according to the procedure, established by the body (organization) appointed by the relevant executive body".
3. Add Article 13-1 of the following content:
"Article 13-1. Recultivation of subsoil
13-1.1. Subsoil users shall provide recultivation of these lands based on the plan of recultivation for the purpose of protection, recovery and improvement of fertility and other useful properties of the soil on the site where works, and also environmental improvements are carried out.
